IN-CONTEXT TRANSLATIONS

Met het oog op de volledige uitvoering van het model dat in de recente effectenrichtlijnen, met name in Richtlijn 2003/6/EG van het Europees Parlement en de Raad van 28 januari 2003 betreffende handel met voorwetenschap en marktmanipulatie (marktmisbruik) , is neergelegd, waarbij het ECEB wordt belast met de taak om de Commissie van advies te dienen bij de uitoefening van haar regelgevende bevoegdheden, terwijl de organisatie van andere aspecten van de werkzaamheden van het ECEB worden geregeld bij Besluit 2001/528/EG, dient tot schrapping te worden overgegaan van de in artikel 53 van Richtlijn 85/611/EEG vervatte bepalingen tot regeling van de organisatie en taken van het huidige icbe-Contactcomité wanneer dit comité niet in de hoedanigheid van comitologiecomité handelt.
In order to fully implement the model set out in recent Directives in the securities field, in particular Directive 2003/6/EC of the European Parliament and of the Council of 28 January 2003 on insider dealing and market manipulation (market abuse) , which gives to the ESC the function to advise the Commission in the exercise of its regulatory powers, while leaving the organisation of other aspects of the ESC's work to be governed by Decision 2001/528/EC, it is necessary to delete the provisions setting up, under Article 53 of Directive 85/611/EEC, the organisation and functions of the present UCITS Contact Committee outside its ‘comitology’ capacity.

Op 3 december 2002 heeft de Raad de Commissie verzocht stappen te ondernemen om onder meer de taak van het icbe-Contactcomité als adviesorgaan van de Commissie bij de uitoefening van haar uitvoeringsbevoegdheden over te dragen aan het ECEB.
On 3 December 2002, the Council invited the Commission to take steps in order to transfer to the ESC, inter alia, the function of advice to the Commission in the exercise of its implementing powers held by the UCITS Contact Committee.

In het licht van deze ontwikkelingen heeft de Commissie op 6 juni 2001 de Besluiten 2001/527/EG en 2001/528/EG tot instelling van respectievelijk het Comité van Europese effectenregelgevers (CEER) en het Europees Comité voor het effectenbedrijf (ECEB) aangenomen.
In the light of those developments, the Commission adopted on 6 June 2001 Decisions 2001/527/EC and 2001/528/EC setting up, respectively, the Committee of European Securities Regulators (CESR) and the European Securities Committee (ESC).

Daarom dienen de bevoegdheden die reeds bij Richtlijn 2003/6/EG aan het ECEB zijn verleend, uitdrukkelijk op een zodanige wijze te worden uitgebreid dat zij ook de taken bestrijken die thans in Richtlijn 85/611/EEG zijn omschreven.
The competences of the ESC should therefore be expressly extended beyond those already conferred upon it by Directive 2003/6/EC, to cover the functions currently laid down in Directive 85/611/EEC.
