24. betreurt de op 22 mei 2014 gepubliceerde uitspraak van het Gerecht voor ambtenarenzaken van de Europese Unie waarin het EESC wordt veroordeeld voor het schenden van het Handvest van de grondrechten van de Europese Unie in verband met het ontslag van één van zijn personeelsleden in 2013; betreurt eveneens het arrest van het Hof van Justitie van de Europese Unie van 8 oktober 2014 in zaak T-530/12 P (M.B.G./EESC) in het nadeel van het EESC en met betrekking tot de melding van onregelmatigheden tegen de vroegere secretaris-generaal door het hoofd van de juridische dienst van het EESC; vraagt aan het EESC en zijn nieuwe secretaris-generaal passende maatregelen te nemen om ervoor te zorgen dat er zich geen nieuwe ernstige schendingen van het Handvest van de grondrechten van de Europese Unie voordoen, en het bureau, de leden en al het personeel te informeren over de inhoud van beide arresten, alsook over de verplichting voor ambtenaren en statutaire personeelsleden om onregelmatigheden te melden, en over het feit dat het bureau van het EESC het bevoegde orgaan is om dergelijke meldingen te ontvangen; vraagt eveneens het Parlement op de hoogte te brengen van de totale juridische kosten van de afgelopen 5 jaar met betrekking tot personeelszaken die voor het gerecht of de Ombudsman zijn gebracht;
24. Deplores the European Civil Service Tribunal judgment published on 22 May 2014 condemning the EESC for breaching the Charter of Fundamental Rights of the European Union when dismissing one of its staff members in 2013; also deplores the ruling handed down on 8 October 2014 in Case T-530/12 P, M. B. G. v EESC, in which the General Court found against the EESC in connection with the reporting of irregularities concerning the former Secretary-General by the head of the EESC Legal Service; calls on the EESC and its new Secretary-General to take the steps required to prevent further serious breaches of the Charter of Fundamental Rights of the European Union, to inform the EESC Bureau, the members, and the entire staff about the content of the two judgments, and to draw their attention to the fact that officials and other staff covered by the Staff Regulations have an obligation to report irregularities and that the EESC Bureau is an appropriate body to receive such reports; also asks to be informed about the total legal expenses incurred in the last five years in staff cases ultimately dealt with in the courts or by the Ombudsman;

9. verneemt met voldoening dat op de vergadering van het bureau van het EESC van 21 februari 2012 wijzigingen zijn goedgekeurd met betrekking tot de bewijzen van aanwezigheid en de vergoeding voor deelname aan videoconferenties, overeenkomstig de aanbevelingen van het Parlement (meer degelijke waarborgen voor de motivering van de vergoeding uit hoofde van artikel 12 van het besluit van het bureau van het EESC van 21 februari 2012 over de onkostenvergoedingen voor EESC-leden, afgevaardigden van raadgevende comités en hun plaatsvervangers en schrapping van het punt over videoconferenties); wacht met ongeduld op de resultaten van de onderhandelingen tussen het EESC en de Raad om een definitieve en bevredigende oplossing te vinden voor al deze kwesties, waarvoor het besluit afhangt van de Raad;
9. Welcomes the fact that changes were made at the EESC Bureau meeting of 21 February 2012 with regard to confirmation of attendance, and reimbursement for taking part in video conferences , in compliance with the guidance of Parliament (stricter documentary evidence in order to justify entitlement to the allowance referred to in Article 12 of the Decision of the Bureau of the European Economic and Social Committee of 21 February 2012 on the reimbursement of expenses incurred and the allowances received by the Committee members and consultative commission delegates, as well as their respective alternates, and deletion of the point relating to videoconferencing); looks forward to the results of the negotiations between the EESC and the Council with a view to reaching a definitive and satisfactory solution to all these issues, in respect of which the decision depends on the Council;

3.8 Hoewel het ODR-platform in de voorgestelde verordening in staat wordt gesteld om „de geschillenbeslechtingsprocedure online te voeren” (artikel 5, lid 3, sub d)), hoopte het EESC dat de basis zou worden gelegd voor een ODR-systeem ter legitimering van elektronische justitie. Het hoopte op een systeem waarbij gebruik wordt gemaakt van de bestaande technologische middelen en infrastructuur (al dan niet met een real time-karakter), zoals chat, elektronische fora, mailing lists, e-mail, teleconferenties, audio- en videoconferenties en virtuele vergaderzalen. Het EESC hoopte bovendien dat het systeem een impuls zou geven aan justitiële toepassingen en dat ervoor gepleit zou worden om het instrumentarium van de eerste en tweede ODR-generatie bij het proces (online onderhandelen, bemiddelen en geschillen beslechten) in te zetten. Aldus zou het systeem zorgen voor meer „e-bemiddeling” tussen de partijen, een beter productieproces en beter observeerbare en voorspelbare procedures.
3.8 Although the regulation states the ODR platform will have the function of ‘enabling the parties and the ADR entity to conduct the dispute resolution procedure online’ (Article 5(3)(d)), the EESC had hoped that the foundations would be laid for an ODR system that would contribute to the legitimacy of online or electronic justice; it would hope that the system would be shaped in such a way as to re-use and copy existing infrastructure and technological resources, synchronous or asynchronous, such as chat, electronic forums, mailing lists, email, tele-conferencing, audio- and video-conferencing, virtual meeting rooms etc.; that it would improve justice applications and advocate first- and second-generation ODR tools for the process (online negotiation, mediation and arbitration), promoting e-mediation between the parties, a more robust production process and more easily observable and predictable procedures.

Points out that some of the reductions introduced by the Council would jeopardize the EESC's core functions and call into question its ability to meet its legal obligations towards its staff; decides therefore to restore the DB for appropriations available to EESC Members to carry out the institution's core activity of enabling civil society organisations from the Member States to express their views at European level, which at the level of prudent estimates for inflation effectively means a freeze in real terms, to partly restore the DB for staff remuneration and allowances to enable the EESC to meet its obligations towards its staff and to partly restore the DB for interpretation to bring the level back to execution in 2009, which would still, given increased rates for interpretation, mean a decrease in real terms;

Following the signature on 24 September 2001 of the cooperation protocol between Presidents Prodi and Frerichs, the Commission adopted a guide in April 2002 covering the different aspects of the Commission's policy with regard to the European Economic and Social Committee and the practical application of the programming of and participation in the proceedings of the Committee.
