TRADUCTIONS EN CONTEXTE

overwegende dat er enkele wijzigingen zijn aangebracht in de door ESMA goedgekeurde ontwerpen van TRN's, zoals de toevoeging van twee nieuwe overwegingen en een aantal wijzigingen in artikel 3 en artikel 6, lid 3, en in de bepaling over inwerkingtreding en toepassing; overwegende dat de gedelegeerde verordening op grond van deze wijzigingen niet kan worden beschouwd als identiek aan de door ESMA goedgekeurde ontwerpen van TRN's, in de zin van artikel 13, lid 1, tweede alinea, van de ESMA-verordening; overwegende dat er dus een bezwaartermijn van drie maanden geldt, zoals bepaald in artikel 13, lid 1, eerste alinea, van de ESMA-verordening, hetgeen betekent dat deze termijn op 17 augustus 2016 verstrijkt.
whereas some changes have been introduced into the draft RTS adopted by ESMA, such as the addition of two new recitals as well as a number of changes to Article 3 and Article 6(3) and to the provision on entry into force and application; whereas, in light of these changes, the delegated regulation cannot be considered to be the same as the draft RTS adopted by ESMA, within the meaning of the second subparagraph of Article 13(1) of the ESMA Regulation; whereas, therefore, the three-month period for objection applies, as provided for under the first subparagraph of Article 13(1) of the ESMA Regulation, meaning that such period would expire on 17 August 2016.

The Commission should be empowered to adopt regulatory technical standards developed by ESMA, with regard to the content and format of presentation of the key financial information to be included in the summary, the cases where it is possible for certain information to be omitted from the prospectus, the information to be incorporated by reference and further types of documents required under Union law, the publication of the prospectus, the data necessary for the classification of prospectuses in the storage mechanism operated by ESMA, the provisions concerning advertisements, the situations where a significant new factor, material mistake or material inaccuracy relating to the information included in the prospectus requires a supplement to the prospectus to be published, the technical arrangements necessary for the functioning of the ESMA notification portal, the minimum content of the cooperation arrangements with supervisory authorities in third countries and the templates to be used therefor, and the information exchanged between competent authorities and ESMA in the context of the obligation to cooperate.

– having regard to the proposal of the Board of Supervisors of the European Securities and Markets Authority (ESMA) of 24 September 2015 to extend the term of office of the Chairperson of the ESMA by another five-year term (C8-0315/2015),

A. overwegende dat de raad van toezichthouders van de ESMA in 2011, na een open selectieprocedure, de eerste voorzitter van de ESMA voor een ambtstermijn van vijf jaar benoemd heeft, overeenkomstig artikel 48, lid 2, van Verordening (EU) nr. 1095/2010;
A. whereas the first Chairperson of the ESMA was appointed by the Board of Supervisors of the ESMA in 2011, following an open selection procedure, for a term of office of five years, in accordance with Article 48(2) of Regulation (EU) No 1095/2010;

C. overwegende dat de raad van toezichthouders van de ESMA op 24 september 2015 voorgesteld heeft het mandaat van Steven Maijoor, de huidige voorzitter van de ESMA, met nog een periode van vijf jaar te verlengen, en het Europees Parlement daarvan dienovereenkomstig op de hoogte heeft gesteld;
C. whereas, on 24 September 2015, the Board of Supervisors of the ESMA proposed to extend the term of office of Steven Maijoor, the incumbent Chairperson of the ESMA, by another five-year term, and informed the European Parliament accordingly;

B. overwegende dat in artikel 48, lid 4, van Verordening (EU) nr. 1095/2010 is bepaald dat de raad van toezichthouders van de ESMA, rekening houdend met de in die bepaling bedoelde beoordeling, het mandaat van de voorzitter van de ESMA één keer kan verlengen, na bevestiging door het Europees Parlement;
B. whereas Article 48(4) of Regulation (EU) No 1095/2010 provides that the Board of Supervisors of the ESMA, taking into account the evaluation referred to in that provision, may extend the term of office of the Chairperson of the ESMA once, subject to confirmation by the European Parliament;

7. ESMA ontwikkelt ontwerpen van technische uitvoeringsnormen ter specificering van de maatregelen om voor te schrijven dat alle in lid 1, onder a), bedoelde rapporten op een vast wekelijks tijdstip aan ESMA worden toegezonden met het oog op de gecentraliseerde bekendmaking ervan door ESMA.
7. ESMA shall develop draft implementing technical standards to specify the measures to require all reports referred to in point (a) of paragraph 1 to be sent to ESMA at a specified weekly time, for their centralised publication by the latter.

2. The obligation of professional secrecy shall apply to all persons who work or who have worked for ESMA, and for the competent authorities or for any other person to whom ESMA has delegated tasks, including auditors and experts contracted by ESMA.
