6. 6. If the EFTA Surveillance Authority has not ruled on an aid measure, national courts can always be guided, in interpreting national law which implemented EEA law, by the case-law of the EFTA Court, the Court of Justice and the Court of First Instance of the European Communities, as well as by decisions issued by the EFTA Surveillance Authority and the Commission.

(3) If the EFTA State fails to suspend payment of the aid, the EFTA Surveillance Authority is entitled, while carrying out the examination on the substance of the matter, to bring the matter directly before the EFTA Court and apply for a declaration that such payment amounts to an infringement of the Agreement (23).
