Where a Member State is seriously disadvantaged by a specific and exceptional situation, including accounting inconsistencies in matching the implementation of Union legislation with the rules agreed under the Kyoto Protocol, without prejudice to the fulfilment of the Member State’s obligations under Decision No 406/2009/EC, the Commission should, subject to the availability of units at the end of the second commitment period of the Kyoto Protocol, adopt measures to address that situation, by means of a transfer of certified emission reductions (CERs), emission reduction units (ERUs) or assigned amount units (AAUs) held in the Union registry to the registry of that Member State.

In order to establish coherent rules to ensure the technical implementation of the second commitment period of the Kyoto Protocol in the Union, including the transition from the first to the second commitment period, to enable the effective operation of the joint fulfilment of the commitments of the Union, its Member States and Iceland for the second commitment period, and to ensure its alignment with the operation of the EU ETS and Decision No 406/2009/EC, the power to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission, from the date of conclusion by the Union of the Doha Amendment to the end of the additional period for fulfilling commitments under the second commitment period of the Kyoto Protocol.

Calls on the Commission to conduct, before the end of 2014, an in-depth assessment of the existing Mutual Legal Assistance Agreement, pursuant to its Article 17, in order to verify its practical implementation and, in particular, whether the US has made effective use of it for obtaining information or evidence in the EU and whether the Agreement has been circumvented to acquire the information directly in the EU, and to assess the impact on the fundamental rights of individuals; such an assessment should not only refer to US official statements as a sufficient basis for the analysis but also be based on specific EU evaluations; this in-depth review should also address the consequences of the application of the Union’s constitutional architecture to this instrument in order to bring it into line with Union law, taking account in particular of Protocol 36 and Article 10 thereof and Declaration 50 concerning this protocol; calls on the Council and Commission also to assess bilateral agreements between Member States and the US so as to ensure that they are consistent with the agreements that the EU follows or decides to follow with the US;

5. HERINNERT AAN de conclusies van de Europese Raad betreffende emissiereducties voor de groep van ontwikkelde landen van 15-30% in 2020, ten opzichte van de referentie in het Protocol van Kyoto, HERINNERT ERAAN dat er geen hiaat mag zijn tussen de eerste en de tweede verbintenisperiode , BENADRUKT dat de internationale onderhandelingen over een overeenkomst voor de periode na 2012 in 2007 aanzienlijk moeten worden versneld, teneinde die onderhandelingen uiterlijk eind 2009 af te ronden; ZIET in dit verband UIT naar de verdere analyse van de Commissie van de kosten en baten van de strategieën voor emissiereductie; ZIET er eveneens naar UIT dat de Europese Raad van voorjaar 2007 mogelijkheden zal bekijken voor een wereldwijde overeenkomst voor de periode na 2012 die spoort met de doelstelling van de EU, zijnde een maximale wereldwijde temperatuurstijging van 2 º Celsius boven de pre-industriële niveaus, dat de voorjaarsbijeenkomst van de Europese Raad de potentiële bijdrage van de EU aan een dergelijke overeenkomst zal bepalen en dat hij de EU-strategieën zal schetsen om in de volgende decennia de technologische overgang te maken naar een economie met een lage uitstoot van broeikasgassen en om de overwegingen inzake klimaatverandering in andere beleidsdomeinen te integreren, met name energiezekerheid en innovatie;

RECALLING the European Council's conclusions on emissions reduction pathways for the group of developed countries in the order of 15-30% by 2020 compared to the baseline envisaged in the Kyoto Protocol and RECALLING that there should be no gap between the first and the second commitment periods, STRESSES the need to significantly accelerate international negotiations on a post-2012 agreement in 2007 with a view to their completion by the end of 2009 at the latest; in this context, LOOKS FORWARD to the Commission's further analysis of costs and benefits of emission reduction strategies; also LOOKS FORWARD to the 2007 Spring European Council considering options for a global post-2012 agreement consistent with the EU's objective of a maximum global temperature increase of 2°C above pre-industrial levels, defining the EU's potential contribution to such an agreement and outlining EU strategies for making the technology transition to a low greenhouse-gas-emitting economy over the next couple of decades and for integrating climate change concerns in other policy areas, in particular energy security and innovation;

In afwachting van de resultaten van een onderzoek naar de toestand van de visbestanden in Guinese wateren, zijn de visserijbetrekkingen tussen Guinee en de Gemeenschap begrijpelijkerwijs met slechts één jaar verlengd. Uiteraard brengt het protocol tussen Guinee en de Europese Unie beide partners voordeel. Awaiting the results of a survey on the state of fish stocks in Guinean waters, the fisheries relations between the Republic of Guinea and the Community were understandably extended with only one year. It is obvious that the protocol between Guinea and the European Union is profitable for both sides. It will continue to contribute to the development of local fisheries and will thus increase the country’s food security. It will also ensure continuity of activity, at least till the end of this year, for much of the European fleet in these waters. This protocol will also contribute to the conservation of the country’s fishery resources through the controlled and rational exploitation which only this type of agreement can offer.
