(31) ‘advertising’ means any presentation of organic products to the public, by any means other than a label, that is intended or is likely to influence and shape attitude, beliefs and behaviours in order to promote directly or indirectly the sale of organic products.

Om verdere problemen te voorkomen en om het verband te verduidelijken tussen enerzijds Verordening (EG) nr. 1235/2008 van de Commissie van 8 december 2008 houdende bepalingen ter uitvoering van Verordening (EG) nr. 834/2007 van de Raad wat de regeling voor de invoer van biologische producten uit derde landen betreft (2) en anderzijds Verordening (EG) nr. 889/2008 van de Commissie van 5 september 2008 tot vaststelling van bepalingen ter uitvoering van Verordening (EG) nr. 834/2007 van de Raad inzake de biologische productie en de etikettering van biologische producten, wat de biologische productie, de etikettering en de controle betreft (3), moet worden herinnerd aan de taken van de controlerende autoriteiten of controleorganen van de lidstaten ten aanzien van niet-conforme producten die worden ingevoerd uit overeenkomstig artikel 33, lid 2, van Verordening (EG) nr. 834/2007 erkende derde landen of uit derde landen die beschikken over overeenkomstig artikel 33, lid 3, van die verordening erkende controlerende autoriteiten of controleorganen.
In order to avoid further difficulties and to clarify the link between Commission Regulation (EC) No 1235/2008 of 8 December 2008 laying down detailed rules for implementation of Council Regulation (EC) No 834/2007 as regards the arrangements for imports of organic products from third countries (2) and Commission Regulation (EC) No 889/2008 of 5 September 2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control (3), it is necessary to recall the duties of the control authorities or control bodies of Member States as regards non-compliant products imported from third countries recognised in accordance with Article 33(2) of Regulation (EC) No 834/2007 or from third countries having control authorities or control bodies recognised in accordance with Article 33(3) of that Regulation.

The examination of the information submitted with that request and subsequent clarifications provided by the Swiss authorities have led to the conclusion that in that country the rules governing production and controls of organic wine are equivalent to those laid down in Regulation (EC) No 834/2007 and Commission Regulation (EC) No 889/2008 of 5 September 2008 laying down detailed rules for the implementation of Council Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control (4).
