Voorts volgt de Commissie van nabij de werkzaamheden van de Europese Octrooiorganisatie in het kader van de herziening van het Verdrag van München om na te gaan onder welke voorwaarden in het Europees octrooirecht rekening kan worden gehouden met de effecten van verspreiding vóór deponering.
The Commission is also keeping a close eye on work carried out by the European Patent Organisation as part of the revision of the Munich Convention in order to see how the effects of disclosures prior to filing can be taken into account by European patent law.

(17) In order to determine the appropriate level and distribution of renewal fees and to ensure that all costs of the tasks in relation to the unitary patent protection entrusted on the European Patent Office are fully covered by the resources generated by the European patents with unitary effect and that, together with the fees to be paid to the European Patent Organisation during the pre-grant stage, the revenues from the renewal fees ensure a balanced budget of the European Patent Organisation.

This expert committee shall be established by the participating Member States in the framework of the European Patent Organisation and shall be composed of representatives of the European Patent Office and of the non-governmental organisations representing users of the European patent system invited by the Administrative Council of the European Patent Organisation as observers in accordance with Article 30(3) of the EPC.

(19) Om een passende hoogte en een geschikte verdeling van de vernieuwingstaksen overeenkomstig de in deze verordening vastgelegde beginselen te garanderen, moet de bevoegdheid handelingen vast te stellen overeenkomstig artikel 290 van het Verdrag betreffende de werking van de Europese Unie aan de Commissie worden gedelegeerd met betrekking tot het niveau van de vernieuwingstaksen voor Europese octrooien met eenheidswerking en de verdeling van deze taksen tussen de Europese Octrooiorganisatie en de deelnemende lidstaten.
(19) In order to ensure the appropriate level and distribution of renewal fees in compliance with the principles set out in this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of the level of the renewal fees for European patents with unitary effect and the distribution of such fees between the European Patent Organisation and the participating Member States.

(5) Bij het Verdrag inzake de verlening van Europese octrooien (Europees Octrooiverdrag), zoals gewijzigd (hierna "EOV" genoemd), is de Europese Octrooiorganisatie opgericht, die met de verlening van Europese octrooien is belast.

Daarbij komt nog de kwestie van het stelsel voor beslechting van octrooigeschillen. Hiervoor moeten de relaties tussen de EU en de Europese Octrooiorganisatie geregeld worden op een manier die conform is met de bevoegdheden van de Europese instellingen, met inbegrip van het Europees Parlement.
On top of this, however, there is the matter of the patent court system, the establishment of which will require regulation of the relationship between the European Union and the European Patent Organisation in a way which is in accordance with the competences of EU institutions, including the European Parliament.
