RECALLING in this regard that the provisions of the Agreement that fall within the scope of Part III, Title V of the Treaty on the Functioning of the European Union bind the United Kingdom and Ireland as separate Contracting Parties, and not as part of the European Union, until the European Union (as the case may be) notifies the Republic of Korea that either State has become bound on these matters as part of the European Union in accordance with the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and the Treaty on the Functioning of the European Union, and that the same applies to Denmark, in accordance with the relevant Protocol annexed to those Treaties;

28. wijst erop dat grenzen geen belemmering vormen voor de georganiseerde criminaliteit; acht het derhalve noodzakelijk ook de externe dimensie van het fenomeen te integreren in het Europese kader ter bestrijding van de georganiseerde criminaliteit; merkt op dat het van belang is de Europese Dienst voor extern optreden en het gemeenschappelijk Situatiecentrum (Sitcen) hier meer bij te betrekken; vraagt de Europese Commissie steeds effectiever vorm te geven aan de samenwerkingsovereenkomsten op justitieel en onderzoeksgebied met derde landen ter bestrijding van de grensoverschrijdende criminaliteit, en deze constant bij te werken; verlangt bovendien dat bij de opstelling van dergelijke overeenkomsten voldoende rekening wordt gehouden met de specifieke dreigingen die uitgaan van de georganiseerde criminaliteit in de afzonderlijke landen voor de interne en externe veiligheid van de Europese Unie; vraagt Europol om frequentere en meer gedetailleerde analyses van niet-Europese criminele organisaties te verrichten waarvan de activiteiten een directe of indirecte weerslag hebben op de Europese Unie; is van mening dat de handhaving en intensivering van het engagement van de Europese Unie en de internationale instellingen in de Balkanregio essentieel is, met name gelet op maatregelen ter bestrijding van de georganiseerde criminaliteit; vraagt de Europese Commissie om in samenwerking met Europol een gemeenschappelijk project met Interpol op te zetten ter ondersteuning van de oprichting en uitvoering van een regionaal systeem voor uitwisseling van politiële en justitiële informatie met West-Afrika, en daarbij de noodzakelijke knowhow en middelen, ook op het gebied van opleiding en follow-up, ter beschikking te stellen aan de Economische Gemeenschap van West-Afrikaanse staten;
28. Points out that borders are not an obstacle to organised crime; considers it necessary, therefore, for the external dimension of organised crime to be integrated into the framework of Europe's effort to combat the phenomenon; notes that it is important, to that end, to involve more deeply the European External Action Service and the Joint Situation Centre (SitCen); calls on the Commission to continue to hone the effectiveness of and regularly update agreements on judicial and investigative cooperation with non-EU countries aimed at combating cross-border organised crime; calls, furthermore, for due account to be taken when drafting such agreements of the specific threats that organised crime in the individual countries poses to the EU's internal and external security; calls on Europol to produce more frequent and more detailed analyses of non-European criminal organisations whose activities have a direct or indirect impact on the European Union; considers it essential to continue and step up the efforts being made by the EU and the international institutions in the Balkans, particularly in connection with action to combat organised crime; calls on the Commission, in collaboration with Europol, to develop a joint project with Interpol to support the establishment and implementation of a regional system for the exchange of police and judicial information with West Africa, while making available to the Economic Community of West African States the necessary know-how and resources, not least in the field of training and follow-up;

The President of the Council is hereby authorised to designate the person empowered, on behalf of the European Union, to exchange the instruments of approval provided for in Article 22 of the Agreement on extradition between the European Union and the United States of America and in Article 18 of the Agreement on mutual legal assistance between the European Union and the United States of America, in order to express the consent of the European Union to be bound.

As regards Liechtenstein, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis which fall within the area referred to in Article 1, point G of Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2008/262/JHA of 28 February 2008 on the signature, on behalf of the European Union, and on the provisional application of certain provisions of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation's association with the implementation, application and development of the Schengen acquis (7).

9. dringt aan op behoud van alle grondbeginselen zoals die vervat zijn in deel I van het Grondwettelijk Verdrag, met inbegrip van de dubbele aard van de Europese Unie als een unie van staten en een unie van burgers, het primaat van de Europese wetgeving, de nieuwe typologie van wetgeving en procedures, de wetgevingshiërarchie en de rechtspersoonlijkheid van de Europese Unie; en beklemtoont dat het Grondwettelijk Verdrag ook andere belangrijke verbeteringen meebrengt ten aanzien van onderwerpen als consolidering van de bestaande verdragen en de samenvoeging van pijlers, de uitdrukkelijke erkenning van de waarden waarop de Europese Unie is gegrondvest en het wettelijk bindende karakter van het Handvest van de grondrechten, alsmede ten aanzien van de bevordering van de participatie van burgers in het politieke leven van de Europese Unie, verduidelijking van de respectieve bevoegdheden van de Europese Unie en de lidstaten, inachtneming van het subsidiariteitsbeginsel, en de specifieke rol van nationale parlementen op dit gebied zonder het institutionele evenwicht van de Europese Unie in gevaar te brengen, zoals vastgelegd in het protocol betreffende de toepassing van het subsidiariteitsbeginsel, en eerbiediging van de rol van regionale en lokale autoriteiten;
9. Insists on the preservation of all basic principles as contained in Part I of the Constitutional Treaty, including the dual nature of the European Union as a union of States and of citizens, the primacy of the European law, the new typology of acts and procedures, the hierarchy of norms, and the legal personality of the European Union; stresses that the Constitutional Treaty also brings about other important improvements in matters such as consolidation of the existing Treaties and the merging of pillars, the express recognition of the values on which the European Union is based and of the legally binding force of the Charter of Fundamental Rights, as well as enhancing the participation of citizens in the political life of the European Union, clarification of the respective competencies of the European Union and of the Member States, respect for the principle of subsidiarity and the specific role of national parliaments in this matter, without jeopardising the institutional balance of the European Union, as enshrined in the protocol on subsidiarity, and respect for the role of regional and local authorities;
