6. 6. The Board shall endeavour to cooperate closely with any public financial assistance facility including the European Financial Stability Facility (EFSF) and the European Stability Mechanism (ESM), in particular in the extraordinary circumstances referred to in Article 27(9) and where such a facility has granted, or is likely to grant, direct or indirect financial assistance to entities established in a participating Member State.

It is appropriate to specify that the notion of financial instruments as referred to in this Directive is given the same meaning as in other internal market legislation and, in view of the recent creation of the European Financial Stability Facility and the European Stability Mechanism, it should be stipulated that operations conducted with that Facility and that Mechanism should be excluded from the scope of this Directive.

5. Behoudens de artikelen 1, 4 en 6 werkt de ECB nauw samen met openbare faciliteiten voor financiële steun, waaronder de Europese Faciliteit voor financiële stabiliteit (EFSF) en het ESM, met name wanneer zo’n faciliteit directe of indirecte financiële steun aan een onder artikel 4 vallende kredietinstelling heeft verleend of waarschijnlijk zal verlenen.

Subject to Articles 1, 4 and 6, the ECB shall cooperate closely with any public financial assistance facility including the European Financial Stability Facility (EFSF) and the ESM, in particular where such a facility has granted or is likely to grant, direct or indirect financial assistance to a credit institution which is subject to Article 4.

To address the difficulties of Member States that have been particularly affected by the economic crisis, the Commission considers that the total coverage of each Member State that is benefitting from financial assistance under the facility providing medium-term financial assistance for non-euro-area Member States, as established by Council Regulation (EC) No 332/2002 (61), the European Financial Stability Facility (EFSF) (62), the European Financial Stabilisation Mechanism (EFSM) (63) or the European Stability Mechanism (ESM) (64) should not be reduced compared to the period 2007-2013.

Under that Treaty, which follows the European Council Decision 2011/199/EU of 25 March 2011 amending Article 136 of the Treaty on the Functioning of the European Union with regard to a stability mechanism for Member States whose currency is the euro , the ESM will assume the tasks currently fulfilled by the European Financial Stability Facility (EFSF) and the European Financial Stabilisation Mechanism (EFSM), by 2013.
