De evaluatie van de tenuitvoerlegging van het milieubeleid (EIR) is onderdeel van het beleid voor betere regelgeving van de Commissie. Dit houdt onder meer in dat de tenuitvoerlegging van bestaande wetgeving en beleidslijnen wordt verbeterd.

6. betreurt dat de EU-wetgeving op gebied van milieu en gezondheid nog steeds afbreuk lijdt door de vele gevallen van te late of onjuiste omzetting en slechte uitvoering door de lidstaten; merkt op dat uit het 31ste jaarlijkse verslag van de Commissie over de toepassing van het EU-recht blijkt dat de grootste categorie inbreukprocedures in 2013 betrekking had op het milieu; herinnert eraan dat in gebreke blijven met de uitvoering van milieubeleid hoge kosten met zich brengt, naar schatting namelijk zo'n 50 miljard EUR per jaar, de proceskosten van inbreukprocedures meegerekend (COWI et al. 2011); benadrukt bovendien dat de uitvoering van het milieubeleid vele sociaaleconomische voordelen zou opleveren die in kosten-batenanalyses niet altijd terug te vinden zijn;

Deplores the fact that EU environmental and health legislation continues to be affected by high numbers of cases of late transposition, incorrect transposition and bad application by the Member States; notes that the Commission’s 31st annual report on the application of EU law shows that in 2013 the biggest category of infringement proceedings was environment-related; recalls that the costs of failing to implement environmental policy – including the costs of infringement proceedings – are high, being estimated at around EUR 50 billion per annum (COWI et al., 2011); stresses, moreover, that the implementation of environmental policy would yield many socioeconomic benefits which are not always registered by cost-benefit analyses;

1. Not later than 30 September 2005, the Commission shall submit to the European Parliament and the Council a report updating the mid-term review submitted in November 2003 and evaluating the implementation of this Regulation, its contribution to the development of Community environmental policy, and the use made of the appropriations together, if appropriate, with a proposal concerning a fourth phase of LIFE, or alternative arrangements for a financial instrument in the environmental field, to apply from 2007 onwards.
