TRADUCTIONS EN CONTEXTE

Daar de doelstellingen van deze verordening, namelijk het ondersteunen van investeringen in de Unie en het bieden van een betere toegang tot financiering aan entiteiten, niet voldoende, wat de financiële beperkingen voor investeringen betreft, door de lidstaten kunnen worden verwezenlijkt wegens hun uiteenlopende budgettaire manoeuvreerruimte ten aanzien van de financiering van investeringen, maar vanwege de omvang en de gevolgen daarvan beter door de Unie kunnen worden verwezenlijkt, kan de Unie, overeenkomstig het in artikel 5 VEU neergelegde subsidiariteitsbeginsel, maatregelen nemen.
Since the objectives of this Regulation, namely to support investments in the Union and to ensure increased access to financing for entities, cannot, as far as financial constraints to investment are concerned, be sufficiently achieved by the Member States by reason of the disparities in their fiscal capacity to finance investment but can rather, by reason of its scale and effects, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 TEU.

(19)Afwikkelingsautoriteiten moeten de bevoegdheid hebben om wijzigingen in de structuur en organisatie van instellingen of groepen te eisen teneinde praktische belemmeringen voor de toepassing van afwikkelingsinstrumenten weg te nemen en de afwikkelbaarheid van de betrokken entiteiten te waarborgen.Wegens de potentiële systeemrelevantie van alle instellingen is het voor het handhaven van de financiële stabiliteit van cruciaal belang dat autoriteiten over de mogelijkheid beschikken om elke instelling af te wikkelen.Om de in artikel van het Handvest van de grondrechten vastgelegde vrijheid van ondernemerschap te respecteren, dient de manoeuvreerruimte van de autoriteiten te worden beperkt tot hetgeen noodzakelijk is om de structuur en bedrijfsactiviteiten van de instelling te vereenvoudigen met de uitsluitende bedoeling om de afwikkelbaarheid ervan te verbeteren.Elke maatregel die met dit doel wordt opgelegd, moet bovendien in overeenstemming zijn met het Unierecht.Maatregelen mogen niet direct of indirect discriminerend zijn op grond van nationaliteit en moeten gerechtvaardigd zijn door de doorslaggevende reden dat ze in het algemeen belang bij financiële stabiliteit worden uitgevoerd.Om te bepalen of een maatregel in het algemeen belang is genomen, moeten in het algemeen belang handelende afwikkelingsautoriteiten hun afwikkelingsdoelstellingen kunnen verwezenlijken zonder belemmeringen tegen te komen voor de toepassing van afwikkelingsinstrumenten of voor hun vermogen om de hun verleende bevoegdheden uit te oefenen.Bovendien mag een maatregel niet verder gaan dan minimaal noodzakelijk is om de doelstellingen te bereiken.Bij het bepalen van de te nemen maatregelen moeten de afwikkelingsautoriteiten rekening houden met de waarschuwingen en aanbevelingen van het Europees Comité voor systeemrisico's dat is opgericht bij Verordening (EU) nr. / van het Europees Parlement en de Raad van november betreffende macroprudentieel toezicht van de Europese Unie op het financiële ...
(19)Resolution authorities should have the power to require changes to the structure and organization of institutions or groups in order to remove practical impediments to the application of resolution tools and ensure the resolvability of the entities concerned.Due to the potentially systemic nature of all institutions, it is crucial in order to maintain financial stability that authorities have the possibility to resolve any institution. In order to respect the right to conduct business laid down by Article 16 of the Charter of Fundamental Rights, the authorities' discretion should be limited to what is necessary in order to simplify the structure and operations of the institution solely to improve its resolvability. In addition, any measure imposed for such purposes should be consistent with Union law. Measures should be neither directly nor indirectly discriminatory on ground of nationality, and be justified by the overriding reason of being conducted in the public interest in financial stability. To determine whether an action was taken in the general public interest, resolution authorities, acting in the general public interest, should be able to achieve their resolution objectives without encountering impediments to the application of resolution tools or their ability to exercise the powers conferred to them. Furthermore, an action should not go beyond the minimum necessary to attain the objectives. When determining the measures to be taken, resolution authorities should take into account the warnings and recommendations of the European Systemic Risk Board established under Regulation (EU) No 1092/2010of the European Parliament and of the Council of 24 November 2010 on European Union macro-prudential oversight of the financial system and establishing a European Systemic Risk Board
