Verklaring nr. 21 betreffende de bescherming van persoonsgegevens op het gebied van justitiële samenwerking in strafzaken en politiële samenwerking, gehecht aan het VEU en het VWEU bepaalt dat, vanwege de specifieke aard van de justitiële samenwerking in strafzaken en de politiële samenwerking, op die gebieden specifieke voorschriften inzake de bescherming van persoonsgegevens en het vrije verkeer van die gegevens op basis van artikel 16 VWEU nodig zouden kunnen blijken.
Declaration No 21 on the protection of personal data in the fields of judicial cooperation in criminal matters and police cooperation, annexed to the TEU and to the TFEU, provides that specific rules on the protection of personal data and the free movement of such data in the fields of judicial cooperation in criminal matters and police cooperation based on Article 16 TFEU may prove to be necessary because of the specific nature of these fields.

3. Bij gebreke van een rechtsinstrument inzake samenwerking in strafzaken en uitlevering tussen het EOM en de bevoegde autoriteiten van de lidstaten van de Europese Unie die niet deelnemen aan nauwere samenwerking bij de instelling van het EOM, zorgen de lidstaten voor kennisgeving dat het EOM de bevoegde autoriteit is voor de uitvoering van de toepasselijke handelingen van de Unie op het gebied van justitiële samenwerking in strafzaken met betrekking tot zaken die onder de bevoegdheid van het EOM vallen, in het kader van hun betrekkingen met lidstaten van de Europese Unie die niet deelnemen aan nauwere samenwerking bij de instelling van het EOM.
3. In the absence of a legal instrument relating to cooperation in criminal matters and surrender between the EPPO and the competent authorities of the Member States of the European Union which do not participate in enhanced cooperation on the establishment of the EPPO, the Member States shall notify the EPPO as a competent authority for the purpose of implementation of the applicable Union acts on judicial cooperation in criminal matters in respect of cases falling within the competence of the EPPO, in their relations with Member States of the European Union which do not participate in enhanced cooperation on the establishment of the EPPO.

As Declaration No 21 on the protection of personal data in the fields of judicial cooperation in criminal matters and police cooperation, attached to the TEU and the TFEU, recognises the specificity of personal data processing in the law enforcement context, the data protection rules of Europol should be autonomous while at the same time consistent with other relevant data protection instruments applicable in the area of police cooperation in the Union.

(10) In Declaration 21 on the protection of personal data in the fields of judicial co-operation in criminal matters and police co-operation, annexed to the final act of the intergovernmental conference which adopted the Treaty of Lisbon, the Conference acknowledged that specific rules on the protection of personal data and the free movement of such data in the fields of judicial co-operation in criminal matters and police co-operation based on Article 16 of the Treaty on the Functioning of the European Union may prove necessary because of the specific nature of these fields.
