TRADUCTIONS EN CONTEXTE

1. Wanneer een beslissing inzake een schuldvordering die niet-betwist is in de zin van artikel 3, punt 4, onder b), of van artikel 3, punt 4, onder c), wegens het ontbreken van verweer of wegens het niet-verschijnen ter terechtzitting van de schuldenaar, als Europese executoriale titel is gewaarmerkt, heeft de schuldenaar het recht op zijn verzoek van de gevolgen van het verstrijken van de termijn voor het instellen van een gewoon rechtsmiddel tegen de beslissing door het bevoegde gerecht in de lidstaat van oorsprong te worden ontheven, indien ten minste aan de volgende voorwaarden is voldaan:
1. If a judgment on a claim that is uncontested within the meaning of Article 3(4)(b) or (c) because of the absence of objections or because of the default of appearance at a court hearing has been certified as a European enforcement order , the debtor shall be entitled to be relieved from the effects of the expiration of the time for ordinary appeal against the judgment by the competent court of the Member State of origin upon application at least if the following conditions are fulfilled:

Een beslissing inzake een schuldvordering die onbetwist is in de zin van artikel 3, punt 4, onder b) of c), wegens het ontbreken van verweer of wegens het niet ter terechtzitting verschijnen van de schuldenaar, kan alleen als Europese executoriale titel worden gewaarmerkt indien de gerechtelijke procedure in de lidstaat van oorsprong aan de in dit hoofdstuk vastgestelde procedurale vereisten voldoet.
A judgment on a claim that is uncontested within the meaning of Article 3(4)(b) or (c) because of the absence of objections or because of the default of appearance at a court hearing can be certified as a European enforcement order only if the court proceedings in the Member State of origin met the procedural requirements as set out in this Chapter.
