In geval van annulering of vertraging van het vertrek waarbij een verblijf van één of meer nachten of een langer verblijf dan door de passagier gepland noodzakelijk wordt, biedt de vervoerder, voor zover en indien zulks fysiek mogelijk is, de passagiers die uit haventerminals vertrekken, naast de in lid 1 bepaalde snacks, maaltijden of verfrissingen ook gratis passend verblijf aan boord of op de wal aan, evenals vervoer tussen de haventerminal en de plaats van het verblijf.
2. In the case of a cancellation or a delay in departure where a stay of one or more nights or a stay additional to that intended by the passenger becomes necessary, where and when physically possible, the carrier shall offer passengers departing from port terminals, free of charge, adequate accommodation on board, or ashore, and transport to and from the port terminal and place of accommodation in addition to the snacks, meals or refreshments provided for in paragraph 1.

5. Onverminderd Richtlijn 2006/87/EG en Richtlijn 2009/45/EG wordt niets in deze verordening uitgelegd als een technisch vereiste dat vervoerders, terminalexploitanten of andere entiteiten verplicht hun schepen, infrastructuur, havens of haventerminals, te verbouwen of te vervangen.
5. Without prejudice to Directive 2006/87/EC and to Directive 2009/45/EC, nothing in this Regulation shall be understood as constituting technical requirements imposing obligations on carriers, terminal operators or other entities to modify or replace ships, infrastructure, ports or port terminals.
