Daarnaast verleent artikel 6 van het Verdrag betreffende de Europese Unie (VEU) bindende kracht aan de sociale rechten in het Handvest van de grondrechten van de EU. Een horizontale sociale clausule is opgenomen in artikel 9 van het VWEU.
In addition, Article 6 of the Treaty on European Union (TEU) gives binding force to the social rights in the EU Charter of Fundamental Rights. A horizontal social clause is introduced by Article 9 of the Treaty on the Functioning of the EU.

Calls on the Commission to take full account of the correct horizontal social clause as specified in Article 9 TFEU, under which the EU has to take into account requirements linked to the promotion of a high level of employment, the guarantee of adequate social protection, the fight against social exclusion, and a high level of education, training and protection of human health, and calls on the Commission to specify how the Platform will affect assessments of the implementation of that clause; calls for more in-depth social impact assessments of EU policies, even where those policies are initiated by the European Council rather than the Commission, as in the case of the Euro Plus pact; takes the view that such in-depth analysis of the application of this clause will make it possible to avoid a levelling-down of social standards in Europe and facilitate the development of a common social basis in Europe; calls for this social impact assessment to be carried out in conjunction with associations active in combating poverty, and for it to take the situation of the poorest people in Europe as a benchmark; takes the view that such assessments should involve Parliament, the Committee of the Regions, the European Economic and Social Committee and the Commission departments responsible for social affairs, under the supervision of a director-general reporting to the Commission Secretariat;

9. is van mening dat de door de Commissie gevolgde benadering op dit moment een duidelijk antisociale tendens laat zien waarbij werknemers worden gestraft, precaire arbeid wordt bevorderd, meer ongelijkheid wordt gecreëerd tussen personen en tussen landen, en armoede en sociale rechten worden genegeerd, hetgeen onmiskenbaar in tegenstelling is met de belangrijkste sociale verbeteringen in het Verdrag van Lissabon; dringt er derhalve bij de Commissie op aan haar beleid radicaal te wijzigingen en zich tot het uiterste in te spannen om een nieuwe sociale strategie op te stellen ten einde, op z'n minst, goed vastgelegde sociale rechten en nationale praktijken met betrekking tot collectieve loononderhandelingen en inkomensverdeling te waarborgen, maar tevens om sociale rechten en maatschappelijke vooruitgang voor alle Europese burgers te bevorderen; dringt aan op harde toezeggingen met name op het gebied van de formele vastlegging in een wetgevingstekst van de horizontale sociale clausule, alsook inzake een horizontale antidiscriminatiestrategie en een herziening van de voorwaarden met betrekking tot financiële reddingsoperaties (bail-outs) op grond van sociale verworvenheden en genoemde horizontale sociale clausule;

Considers that the current trend of the Commission's approach is clearly anti-social, in obvious contradiction with the main social advances of the Lisbon Treaty, penalising wage-earners, encouraging precarious work, generating more inequalities between people and countries and ignoring poverty and social rights; asks therefore the Commission to operate a dramatic shift in policy and pull all its strengths into shaping a new social strategy to guarantee as a minimum well established social rights, national practices of collective wage bargaining and income distribution, but also to promote social rights and social progress for all European citizens; requests a strong commitment especially on the horizontal social clause to be formalised in a legislative text as well as an horizontal anti-discrimination strategy and a review of the conditionalities imposed through ‘bail-outs’ from the perspective of social acquis and this horizontal social clause;

Welcomes the proposals for a European Platform against Poverty and Social Exclusion, but calls for more concrete actions to deliver social inclusion, in particular strengthening the Social Open Method of Coordination, as an integrated strategy engaging national and local stakeholders, in particular people who experience poverty and social exclusion; urges the Commission and the Council to embed a rights' based approach that implements the Charter of Fundamental Rights and the Horizontal Social Clause (Art 9 TFEU) to ensure that all policies contribute rather than undermine the poverty-reduction goal;
