Krachtens de Belgische wetgeving wordt een verlaagd tarief uitsluitend toegepast op schenkingen van deelnemingsbewijzen in Belgische icbe's van het closed-end-type en in private icbe's naar Belgisch recht (die kapitaal aantrekken zonder de verkoop van hun deelnemingsbewijzen bij het publiek te bevorderen), maar niet op schenkingen van deelnemingsbewijzen in soortgelijke icbe's uit de rest van de EU.
Belgian legislation provides for a reduced taxation rate only for donations of units in closed-end Belgian UCITS and private Belgian UCITS (which collect capital without promoting the sale of their shares to the public), but not for donations of units in similar UCITS elsewhere in the EU.

Where the dealing arrangements between master UCITS and feeder UCITS do not differ from those applying to all non-feeder unit-holders of the master UCITS and where those arrangements are laid down in the prospectus of the master UCITS, the agreement between master UCITS and feeder UCITS should not have to replicate those standard dealing arrangements, but may cross-refer to the relevant parts of the prospectus of the master UCITS in order to help industry to save costs and reduce the administrative burden.

The possibility of transferring assets in kind to the master UCITS should in particular help those feeder UCITS which have already been carrying on activities as a UCITS, including a feeder UCITS of a different master UCITS, to avoid transaction costs arising from the sale of assets which both the feeder UCITS and the master UCITS have invested in.

Consequently, this Regulation tailors the general rules applicable to all UCITS so as to take into account the specific situation of certain types of UCITS, namely those having different investment compartments or share classes, those with fund of funds structures, those with master-feeder structures, and those that are structured, such as capital protected or comparable UCITS.

where the feeder UCITS and the master UCITS have different accounting years, arrangements for the feeder UCITS to obtain any necessary information from the master UCITS to enable it to produce its periodic reports on time and which ensure that the auditor of the master UCITS is in a position to produce an ad hoc report on the closing date of the feeder UCITS in accordance with the first subparagraph of Article 62(2) of Directive 2009/65/EC.

2. De lidstaten zorgen ervoor dat als de feeder-icbe en de master-icbe in een verschillende lidstaat zijn gevestigd de in de eerste alinea van artikel 60, lid 1, van Richtlijn 2009/65/EG bedoelde overeenkomst tussen de master-icbe en de feeder-icbe erin voorziet dat het recht van de lidstaat waarin de feeder-icbe is gevestigd of het recht van de lidstaat waarin de master-icbe is gevestigd van toepassing is en dat beide partijen instemmen met de exclusieve jurisdictie van de rechtbanken van de lidstaat met betrekking tot het recht waarvan zij hebben bedongen dat dit op de overeenkomst van toepassing is.
2. Member States shall ensure that where the feeder UCITS and the master UCITS are established in different Member States, the agreement between the master UCITS and the feeder UCITS referred to in the first subparagraph of Article 60(1) of Directive 2009/65/EC provides that the applicable law shall be either the law of the Member State in which the feeder UCITS is established or that it shall be that of the Member State in which the master UCITS is established and that both parties agree to the exclusive jurisdiction of the courts of the Member State whose law they have stipulated to be applicable to the agreement.

Gewijzigd voorstel voor een ICBE[2] -richtlijn - op voorstel van het voorzitterschap zal de Raad zonder bespreking een brief aan de Commissie goedkeuren, waarin verzocht wordt om een initiatief om te pogen de discussies tussen de delegaties over dit voorstel van februari 1993, gewijzigd in 1994, waarbij het toepassingsgebied van de bestaande richtlijn betreffende de ICBE's (85/611) zou worden uitgebreid tot fondsen die in andere ICBE's beleggen, geldmarktfondsen en om het mogelijk te maken dat de bezwaarder bij wege van het vrij verrichten van diensten werkzaam is, te deblokkeren.
- 2 - Amended proposal for a Directive relating to undertakings for collective investment in transferable securities (UCITS)[2] On a proposal from the Presidency, the Council is called upon to approve without discussion a letter to the Commission asking for an initiative to try to break the deadlock in the discussions between the delegations on this proposal, published in February 1993 and amended in July 1994, which would extend the scope of the existing UCITS Directive (85/611/EEC) so as to include funds investing in other UCITS and money market funds and to enable depositaries to benefit from the freedom to provide services.

The amendments which have been proposed today incorporate a large number of the amendments proposed by Parliament, particularly by: 1. extending the scope of the Directive to include cash funds which invest 100% of their assets in bank deposits, and feeder funds which invest all of their assets in a single Ucit; 2. allowing Ucits full freedom to use the services of a depository authorized in another Member State under provisions which guarantee effective supervision, thereby ensuring freedom to provide services.
