Die Regelung trägt - dies ist bereits in Art. 3 Abs. 3 der Richtlinie 2004/107/EG zum Ausdruck gekommen - dem Umstand Rechnung, dass Anlagen, die eine Genehmigung im Sinne der IVU-Richtlinie (96/61/EG) erhalten haben, eine spezielle Emittentengruppe darstellen. Denn die IVU-Richtlinie stellt außerordentlich hohe materielle Anforderungen an die betroffenen Anlagen, indem sie zum Einsatz der besten verfügbaren Emissionsminderungstechniken (= BVT) verpflichtet.
The provision takes account of the fact that - as already made clear in Article 3(3) of Directive 2004/107/EC - installations for which permits have been issued pursuant to the IPPC Directive (96/61/EC) constitute a special category of emitter, as the IPPC Directive imposes extremely stringent substantive requirements on the installations concerned, requiring the use of the best available emission reduction technology (= BAT).
