(1) Overeenkomstig artikel 127 van Uitvoeringsverordening (EU) 2015/2447 van de Commissie van 24 november 2015 houdende nadere uitvoeringsvoorschriften voor enkele bepalingen van Verordening (EU) nr. 952/2013 van het Europees Parlement en de Raad tot vaststelling van het douanewetboek van de Unie (PB L 343 van 29.12.2015, blz. 558), worden twee personen geacht te zijn verbonden indien: a) zij functionaris of directeur zijn in de onderneming van de andere persoon; b) zij door de wettelijke bepalingen worden erkend als in zaken verbonden; c) zij werkgever en werknemer zijn; d) een derde partij 5 % of meer van het stemgerechtigde uitstaande kapitaal of de aandelen van beiden direct of indirect bezit, houdt of daarover zeggenschap heeft; e) één van hen direct of indirect zeggenschap over de ander heeft; f) een derde persoon direct of indirect zeggenschap over beiden heeft; g) beiden direct of indirect zeggenschap over een derde persoon hebben; of h) zij tot dezelfde familie behoren.
(1) In accordance with Article 127 of Commission Implementing Regulation (EU) 2015/2447 of 24 November 2015 laying down detailed rules for implementing certain provisions of Regulation (EU) No 952/2013 of the European Parliament and of the Council laying down the Union Customs Code (OJ L 343, 29.12.2015, p. 558), two persons shall be deemed to be related if: (a) they are officers or directors of the other person's business; (b) they are legally recognised partners in business; (c) they are employer and employee; (d) a third party directly or indirectly owns, controls or holds 5 % or more of the outstanding voting stock or shares of both of them; (e) one of them directly or indirectly controls the other; (f) both of them are directly or indirectly controlled by a third person; (g) together they control a third person directly or indirectly; or (h) they are members of the same family.

Regrets that the state aid-based compensation regime for indirect costs has created a new source of unfair competition on the EU single market among producers in electricity-intensive sectors, some of whom receive financial support from the authorities in their countries; urges that this compensation be harmonised and, if justified, be granted at European level in order to ensure a level playing field with global competitors and among European producers and ensure effective carbon leakage protection; notes that this is especially true for the six non-ferrous metals that are traded against prices determined by global demand and supply, mostly set by the London Stock Exchange; understands, therefore, that base metal producers are ‘price-takers’, which are unable to pass cost increases on to their customers; reaches the conclusion that it is imperative to keep compensations on indirect emissions in place; refers to the agreement on the establishment and operation of a market stability reserve which states that ‘in pursuing the goal of a level playing field, that review should also consider harmonised arrangements to compensate for indirect costs at the Union level’ ; refers in this connection to Council Regulation (EC) No 1/2003 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty and to Articles 107 and 108 of the Treaty on the Functioning of the European Union; calls on the Commission to review the impact of various energy support schemes on the retail prices of energy which indirectly influence competitiveness of energy-intensive industries in individual Member States;

In order to prove the existence of passing-on, the indirect purchaser should therefore at least show that the defendant has committed an infringement of Union or national competition law, that the infringement resulted in the direct purchaser of the defendant being overcharged, that the indirect purchaser purchased the goods or services that were the subject of the infringement or purchased goods or services derived from or containing the goods or services that were the subject of the infringement and that the indirect purchaser purchased those goods or services from the direct purchaser or from another indirect purchaser who is directly linked through the supply chain to the defendant.
