5. neemt kennis van het antwoord van de ETGB dat de instelling, wegens haar geringe omvang, bij de behandeling van de dossiers betreffende sociale zekerheid wordt bijgestaan door het Bureau voor het beheer en de afwikkeling van de individuele rechten (PMO), dat de informatie betreffende gezins- en kindertoelagen jaarlijks door het PMO wordt geactualiseerd op basis van specifieke formulieren die via de ETGB aan het personeel worden toegestuurd en dat de sociale uitkeringen worden bijgehouden op basis van de informatie die aan de hand van deze formulieren wordt verkregen; juicht het voornemen van de ETGB toe om in te gaan op de aanbeveling van de Rekenkamer en het toezicht op de informatie betreffende de sociale uitkeringen te verbeteren, en verzoekt de ETGB over de getroffen maatregelen verslag uit te brengen in zijn jaarlijkse activiteitenverslag;

Takes note of the EDPS's reply to the effect that because of its small size, it is assisted by the Office for the Administration and Payment of Individual Entitlements (PMO) in handling the social allowances files, that the information relating to family and dependent child allowances is updated by the PMO once a year on the basis of specific forms addressed to the staff concerned through the EDPS, and that the social allowances are kept up-to-date on the basis of the information gathered through these forms. Welcomes the EDPS's intention to improve the monitoring of information relevant to the social allowances in view of the recommendation of the Court of Auditors, and invites the EDPS to report on the action taken in its Annual Activity Report;

Voor de toepassing van dit artikel wordt onder „informatie betreffende het beheer van rechten” verstaan alle door de rechthebbenden verstrekte informatie die dient ter identificatie van het werk of het andere materiaal, bedoeld in deze richtlijn of bestreken door het in hoofdstuk III van Richtlijn 96/9/EG bedoelde sui generis recht, dan wel van de auteur of een andere rechthebbende, of informatie betreffende de voorwaarden voor het gebruik van het werk of het andere materiaal, alsook de cijfers of codes waarin die informatie vervat ligt.

For the purposes of this Directive, the expression ‘rights-management information’ means any information provided by rightholders which identifies the work or other subject-matter referred to in this Directive or covered by the sui generis right provided for in Chapter III of Directive 96/9/EC, the author or any other rightholder, or information about the terms and conditions of use of the work or other subject-matter, and any numbers or codes that represent such information.

2. Voor de toepassing van dit artikel wordt onder "informatie betreffende het beheer van rechten" verstaan alle door de rechthebbenden verstrekte informatie die dient ter identificatie van het werk of het andere materiaal, bedoeld in deze richtlijn of bestreken door het in hoofdstuk III van Richtlijn 96/9/EG bedoelde sui generis recht, dan wel van de auteur of een andere rechthebbende, of informatie betreffende de voorwaarden voor het gebruik van het werk of het andere materiaal, alsook de cijfers of codes waarin die informatie vervat ligt.

For the purposes of this Directive, the expression "rights-management information" means any information provided by rightholders which identifies the work or other subject-matter referred to in this Directive or covered by the sui generis right provided for in Chapter III of Directive 96/9/EC, the author or any other rightholder, or information about the terms and conditions of use of the work or other subject-matter, and any numbers or codes that represent such information.

b)de verspreiding, de invoer ter verspreiding, de uitzending, de mededeling aan het publiek of de beschikbaarstelling voor het publiek van werken of ander materiaal beschermd krachtens deze richtlijn of krachtens hoofdstuk III van Richtlijn 96/9/EG, waaruit op ongeoorloofde wijze elektronische informatie betreffende het beheer van rechten is verwijderd of waarin op ongeoorloofde wijze dergelijke informatie is gewijzigd,
(b)the distribution, importation for distribution, broadcasting, communication or making available to the public of works or other subject-matter protected under this Directive or under Chapter III of Directive 96/9/EC from which electronic rights-management information has been removed or altered without authority,

b) de verspreiding, de invoer ter verspreiding, de uitzending, de mededeling aan het publiek of de beschikbaarstelling voor het publiek van werken of ander materiaal beschermd krachtens deze richtlijn of krachtens hoofdstuk III van Richtlijn 96/9/EG, waaruit op ongeoorloofde wijze elektronische informatie betreffende het beheer van rechten is verwijderd of waarin op ongeoorloofde wijze dergelijke informatie is gewijzigd,

(57) De hierboven bedoelde informatie betreffende het beheer van rechten kan, afhankelijk van de opzet ervan, ook leiden tot de verwerking van persoonsgegevens betreffende het consumptiepatroon van natuurlijke personen ten aanzien van beschermd materiaal en tot onderzoek naar gedragingen in de on lineomgeving.
(57) Any such rights-management information systems referred to above may, depending on their design, at the same time process personal data about the consumption patterns of protected subject-matter by individuals and allow for tracing of on-line behaviour.

Dit geldt in het bijzonder voor informatie voor het beheer van rechten overeenkomstig artikel 7 van richtlijn 2001/29/EG.
This shall in particular apply with regard to information for the enforcement of rights under Article 7 of Directive 2001/29/EC.
