In het geval van Intech heeft de Commissie vastgesteld dat de onderneming in ruime mate handelde op instructie van Ibiden, waarvan zij de belangrijkste distributeur in Europa was. Dit gegeven rechtvaardigde een verlaging van het basisbedrag van de geldboete met 10%.
