De tenuitvoerlegging van deze verordening doet geen afbreuk aan de verdeling van de bevoegdheden tussen de Unie en de lidstaten krachtens de Verdragen, noch aan de verplichtingen van de lidstaten die voortvloeien uit internationale verdragen zoals het Verdrag van de Verenigde Naties inzake het recht van de zee, het Internationaal Verdrag voor de beveiliging van mensenlevens op zee, het Internationaal Verdrag inzake opsporing en redding op zee, het Internationaal Verdrag ter voorkoming van verontreiniging door schepen, het Internationaal Verdrag betreffende de normen voor zeevarenden inzake opleiding, diplomering en wachtdienst en andere toepasselijke internationale maritieme instrumenten.
The implementation of this Regulation does not affect the division of competence between the Union and the Member States under the Treaties, or the obligations of Member States under international conventions such as the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, the International Convention on Maritime Search and Rescue, the International Convention for the Prevention of Pollution from Ships, the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, and other relevant international maritime instruments.

The European Border and Coast Guard, which includes the Agency and the national authorities of Member States which are responsible for border management, including coast guards to the extent that they carry out border control tasks, should fulfil its tasks in full respect for fundamental rights, in particular the Charter of Fundamental Rights of the European Union (‘the Charter’), the European Convention for the Protection of Human Rights and Fundamental Freedoms, relevant international law, including the United Nations Convention on the Rights of the Child, the Convention on the Elimination of All Forms of Discrimination Against Women, the Convention Relating to the Status of Refugees and obligations related to access to international protection, in particular the principle of non-refoulement, the United Nations Convention on the Law of the Sea, the International Convention for the Safety of Life at Sea, and the International Convention on Maritime Search and Rescue.

The term ‘international conventions’ as defined in Article 2(b) of Regulation (EC) No 391/2009 means the International Convention for the Safety of Life at Sea of 1 November 1974 (the SOLAS Convention) with the exception of chapter XI-2 of the Annex thereto, the International Convention on Load Lines of 5 April 1966 (the Load Lines Convention) and the International Convention for the Prevention of Pollution from Ships of 2 November 1973 (the MARPOL Convention), together with the protocols and amendments thereto, and the related codes of mandatory status in all Member States, in their up-to-date version.
