TRADUCTIONS EN CONTEXTE

Bij de beoordeling van de ontwerpmaatregelen waarvan de Commissie overeenkomstig artikel 7 van Richtlijn 2002/21/EG in kennis is gesteld, is gebleken dat er in de Unie nog steeds aanmerkelijke verschillen zijn wat betreft de toepassing van verplichtingen inzake non-discriminatie overeenkomstig artikel 10 en wat betreft verplichtingen inzake prijscontrole en kostentoerekening overeenkomstig artikel 13 van Richtlijn 2002/19/EG van het Europees Parlement en de Raad (2) met betrekking tot de markten voor wholesaletoegang tot netwerkinfrastructuur (markt 4) en wholesalebreedbandtoegang (markt 5) die zijn vermeld in Aanbeveling 2007/879/EG van de Commissie (3).
During the assessment of draft measures notified to the Commission under Article 7 of Directive 2002/21/EC, it appeared that significant inconsistencies still exist across the Union in the application of non-discrimination obligations under Article 10 and of price control and cost accounting obligations under Article 13 of Directive 2002/19/EC of the European Parliament and of the Council (2) for the market for wholesale network infrastructure access (market 4) and to the wholesale broadband access market (market 5) referred to in Commission Recommendation 2007/879/EC (3).

Where, in the course of the market analysis procedures carried out under Article 15 and Article 16(4) of Directive 2002/21/EC, national regulatory authorities (NRAs) determine that a market referred to in point 5 below is not effectively competitive and identify undertakings that individually or jointly have significant market power (SMP) on that market (as SMP operator(s)), they shall impose, where appropriate, obligations of non-discrimination in relation to interconnection and/or access, pursuant to Article 10 of Directive 2002/19/EC and price control and cost accounting obligations, in particular cost orientation, pursuant to Article 13 of Directive 2002/19/EC.

Stresses that the effective functioning of the market should provide a large part of the cost of the requisite infrastructure investment, on the basis of principles of proper cost-allocation, transparency, non-discrimination and cost-effectiveness and in line with the ‘user pays’ principle; requests the Commission to assess where the existing regulatory incentives are sufficient to send the necessary signals to the market, and what complementary measures, including those improving cost allocation rules, are needed;

Notes the Commission's intention to produce guidance on costing and non-discrimination, key principles in the EU framework, and encourages the Commission to support competition in fast and ultra-fast networks and allow all operators fair access to the infrastructure, in order to ensure a wide choice of services, fair network access rates and affordable prices for consumers, and to incentivise efficient investment and rapid switchover to fast and ultra-fast networks;
