In afwijking van lid 1, kan, indien met bij de aanvraag gevoegde documenten wordt aangetoond dat een werkzame stof nodig is ter bestrijding van een op geen enkele andere manier, ook niet met niet-chemische methoden, te beheersen ernstig fytosanitair gevaar, die werkzame stof voor een beperkte periode van ten hoogste vijf jaar die nodig is om dat ernstige gevaar te bestrijden worden goedgekeurd, zelfs indien zij niet voldoet aan de criteria van de punten 3.6.3, 3.6.4, 3.6.5 of 3.8.2 van bijlage II, mits voor het gebruik van de werkzame stof risicobeperkende maatregelen gelden teneinde te waarborgen dat de blootstelling daaraan van de mens en het milieu wordt geminimaliseerd.
7. By way of derogation from paragraph 1, where on the basis of documented evidence included in the application an active substance is necessary to control a serious danger to plant health which cannot be contained by other available means including non-chemical methods, such active substance may be approved for a limited period necessary to control that serious danger but not exceeding five years even if it does not satisfy the criteria set out in points 3.6.3, 3.6.4, 3.6.5 or 3.8.2 of Annex II, provided that the use of the active substance is subject to risk mitigation measures to ensure that exposure of humans and the environment is minimised.
