7(3): The transfer of goods not specified in the Export Control List (Annex AL) shall require a licence if the final destination of the goods is outside the European Union and if the transferor has been informed by the Federal Office of Economics and Export Control (Bundesamt für Wirtschaft und Ausfuhrkontrolle; BAFA) that the goods are or may be intended, in their entirety or in part, for a military end-use as defined by Section 5c, paragraph 1,sentence 2, and the purchasing country or country of destination is a country on Country List K or a country under embargo as defined by Article 4 paragraph 2 of the Regulation (EC) No 1334/2000.

If the transferor is aware that the items, as defined by sentence 1 above, which he proposes to transfer and the final destination of which is outside the European Union, are intended for a military end-use, and the purchasing country or country of destination is a country of Country List K or a country under embargo as defined by Article 4 paragraph 2 of Regulation (EC) No 1334/2000, he must notify the Federal Office of Economics and Export Control (BAFA); it will decide whether or not the transfer is subject to licensing.
