In een antwoord op de eerste vraag was het Hof van Justitie van mening dat artikel 2, onder a) van de richtlijn, aldus moet worden uitgelegd, dat het van toepassing is op een standpunt dat een dienst voor landschapszorg in het kader van zijn deelneming aan een procedure tot goedkeuring van bouwplannen inneemt, indien dit standpunt vanuit het oogpunt van milieubescherming invloed kan hebben op de beslissing tot goedkeuring van die plannen.
In reply to the first question, the Court of Justice held that Article 2(a) of the Directive is to be interpreted as covering a statement of views given by a countryside protection authority in development consent proceedings if that statement is capable of influencing the outcome of those proceedings as regards interests pertaining to the protection of the environment.
