TRADUCTIONS EN CONTEXTE

In de MAR is vastgesteld dat haar bepalingen niet op die begrippen van toepassing zijn tot de oorspronkelijk geplande datum waarop MiFID II van toepassing wordt. Daarom moet in de MAR worden verduidelijkt dat de bepalingen waarin naar OTF's, mkb-groeimarkten, emissierechten of daarop gebaseerde geveilde producten wordt verwezen, niet van toepassing zijn tot de nieuwe datum waarop MiFID II van toepassing wordt.
MAR sets out that its provisions shall not apply to these concepts until the originally foreseen entry into application of MiFID II. It is therefore also necessary to clarify in MAR that provisions referring to OTFs, SME growth markets, emission allowances or auctioned products based thereon shall not apply until the new date of entry into application of MiFID II.

Om rechtszekerheid te garanderen in de periode tussen de oorspronkelijk geplande datum en de nieuwe datum waarop MiFID II van toepassing wordt, moet in de MAR worden verduidelijkt dat de in MiFID I vastgestelde begrippen en regels zouden moeten worden gebruikt tot de nieuwe datum waarop MiFID II van toepassing wordt. In order to ensure legal certainty for the period between the originally foreseen date of entry into application and the new date of entry into application, it is necessary to clarify in MAR that the concepts and rules as set out in MiFID I should be used until the new date of entry into application of MiFID II. MAR also refers to concepts that will be introduced by MiFID II, such as organised trading facilities ('OTFs'), small and medium-sized enterprises ('SME') growth markets, emission allowances or auctioned products based thereon.

Deze richtlijn is niet van toepassing op handel in eigen aandelen in het kader van terugkoopprogramma's of voor de stabilisatie van een financieel instrument mits die handel plaatsvindt overeenkomstig artikel 3 van Verordening (EU) nr/2012 [MAR], of op transacties of handelsorders die plaatsvinden in het kader van beheersactiviteiten met betrekking tot monetair beleid en overheidsschuld en activiteiten met betrekking tot emissierechten ter uitvoering van het klimaatbeleid van de Unie overeenkomstig artikel 4 van Verordening (EU) nr/2012 [MAR].
2. This Directive does not apply to trading in own shares in buy-back programmes or for the stabilisation of a financial instrument, where such trading is carried out in accordance with Article 3 of Regulation (EU) No./2012 [MAR], or to transactions or orders carried out for the purposes of monetary and public debt management activities and activities concerning emission allowances in pursuit of the Union's climate policy, in accordance with Article 4 of Regulation (EU) No./2012 [MAR].

(14) Terwille van de doeltreffende uitvoering van het Europees beleid dat de integriteit van de financiële markten moet waarborgen, als vastgelegd in Verordening (EU) nr./2014 [marktmisbruikverordening, hierna: MAR] , moeten de lidstaten ook rechtspersonen voor onder deze richtlijn vallende strafbare feiten aansprakelijk stellen door hantering van doeltreffende, evenredige en afschrikkende, al dan niet strafrechtelijke sancties of maatregelen, zoals bijvoorbeeld de sancties genoemd in Verordening (EU) nr/2014 [MAR].
(14) In order to ensure effective implementation of the European policy for ensuring the integrity of the financial markets set out in Regulation (EU) No ./2014 [MAR] , Member States should extend liability for the offences provided for in this Directive to legal persons through the imposition of criminal or non-criminal sanctions or measures which are effective, proportionate and dissuasive, such as for example set out in Regulation (EU) No ./2014 [MAR].

(15 ter) De bij de artikelen 6 en 8 opgelegde verplichtingen ontslaan de lidstaten niet van de verplichting in hun nationale recht te voorzien in administratieve sancties en maatregelen voor onder Verordening (EU) nr./2014 [MAR] vallende inbreuken, tenzij de lidstaten overeenkomstig Verordening (EU) nr./2014 [MAR] hebben besloten voor die inbreuken op hun nationale wetgeving alleen in strafrechtelijke sancties te voorzien.
(15b) The obligations under Articles 6 and 8 do not exempt Member States from the obligation to provide in national law for administrative sanctions and measures for the breaches set out in Regulation (EU) No ./2014 [MAR] unless Member States have decided, in accordance with the provisions of Regulation (EU) No ./2014 [MAR], to lay down only criminal sanctions for such breaches in their national law.

Regrets that contrary to Russia’s obligations as a Member of the Council of Europe to uphold the freedom of assembly, peaceful citizens’ gatherings continue to be banned and violently dispersed, including a gay pride march in Moscow for the sixth consecutive year disregarding a final ruling in April 2011 by the European Court of Human Rights obliging Russia to authorise such gatherings, regrets that the European External Action Service declined to publicly support the organisers of the parade, and calls on the EU representatives at the Summit to convey the disapproval of the EU at this ban;

16. betreurt ten zeerste dat de Moskouse autoriteiten voor het zesde achtereenvolgende jaar het houden van een Gay Pride-mars hebben verboden, hoewel het Europees Hof voor de Rechten van de Mens daarover in april 2011 een definitieve uitspraak heeft gedaan, waarbij Rusland de verplichting werd opgelegd om voortaan het houden van dergelijke bijeenkomsten toe te staan; betreurt dat de Europese dienst voor extern optreden heeft nagelaten zijn publieke steun te betuigen aan de organisatoren van de mars, en verzoekt de voorzitter van de Europese Raad, de hoge vertegenwoordiger/vicevoorzitter van de Commissie en de voorzitter van de Commissie tijdens de top EU-Rusland op het hoogst mogelijke niveau hun bezorgdheid daarover kenbaar te maken; verwacht dat de EU-delegaties en -diplomaten voortaan de Toolkit voor de bevordering en bescherming van alle mensenrechten van lesbiennes, homoseksuelen, biseksuelen en transgenders (LGBT) actief toepassen, onder andere door middel van publieke steunbetuigingen;
16. Strongly regrets that Moscow city authorities banned a gay pride march for the sixth consecutive year, despite a final ruling in April 2011 by the European Court of Human Rights obliging Russia to authorise such gatherings in the future; regrets that the European External Action Service failed to bring its public support to organisers of the parade, and calls on the President of the European Council, the High Representative/Vice-President of the Commission, and President of the Commission to voice their concern at the highest possible level during the EU-Russia Summit; expects that EU delegations and diplomats to actively implement the Toolkit to Promote and Protect the Enjoyment of All Human Rights by LGBT People in the future, including by public statements of support;
