Maatregel 7 (afstand van vorderingen door MIB aan NG): Op 17 april 2009 cedeerde MIB haar uit leningen voortvloeiende schuldvorderingen op CST ten belope van 1 476 830,88 EUR (45) aan NG.

Maatregel 5 (ondersteuning van CST door NG) is volgens Duitsland marktconform: nadat het project aanvankelijk gelijkelijk door NG en MIB was gefinancierd, was MIB later niet meer in staat aandeelhoudersleningen van dezelfde omvang te verstrekken als NG, om in de nodige financiële middelen te voorzien.
Concerning measure 5 (support provided by NG to CST), Germany puts forward that it is market conform: after the initial financing of the project by NG and MIB under parity conditions, the MIB was later unable to provide the necessary shareholder loans in the same amount as NG.

Daarom kwam deze maatregel ten goede aan MIB, die daardoor haar vorderingen kon innen, terwijl NG voor MIB in de plaats kwam als schuldeiser van een onderneming in moeilijkheden.
On this basis, this measure benefitted MIB who received its claims and was replaced by NG who became the creditor of a firm in difficulty.

KG (hierna „MAN” genoemd) (23), Test Training International GmbH (hierna „TTI” genoemd) (24), Bike World Nürburgring GmbH (hierna „BWN1” genoemd) (25), BikeWorld Nürburgring Besitz (hierna „BWNB” genoemd), BikeWorld Nürburgring GmbH (hierna „BWN2” genoemd), Camp 4 Fun GmbH Co. KG (hierna „Camp4Fun” genoemd) (26) en MI-Beteiligungs- und Verwaltungs GmbH (hierna „MIB” genoemd) (27).
