Voor de toepassing van artikel 33, lid 3, tweede alinea, van Verordening (EG) nr. 1782/2003 wordt onder „splitsing” verstaan de splitsing van één landbouwer in ten minste twee nieuwe, aparte landbouwers in de zin van artikel 2, onder a), van Verordening (EG) nr. 1782/2003 waarvan er ten minste één op het gebied van beheer, winst en financiële risico’s onder de verantwoordelijkheid blijft van ten minste één van de rechts- of natuurlijke personen die oorspronkelijk voor het bedrijf verantwoordelijk waren, of de splitsing van één landbouwer waarbij ten minste één nieuwe, aparte landbouwer in de zin van artikel 2, onder a), van Verordening (EG) nr. 1782/2003 ontstaat en waarbij een andere landbouwer op het gebied van beheer, winst en financiële risico’s onder de verantwoordelijkheid blijft van de landbouwer die oorspronkelijk voor het bedrijf verantwoordelijk was.
2. For the purposes of the second subparagraph of Article 33(3) of Regulation (EC) No 1782/2003, ‘scission’ shall mean the scission of one farmer within the meaning of Article 2 (a) of Regulation (EC) No 1782/2003 into at least two new separate farmerswithin the meaning of Article 2 (a) of Regulation (EC) No 1782/2003 of which at least one remains controlled, in terms of management, benefits and financial risks, by at least one of the legal or natural persons originally managing the holding or the scission of one farmer within the meaning of Article 2 (a) of Regulation (EC) No 1782/2003 into at least one new separate farmer within the meaning of Article 2 (a) of Regulation (EC) No 1782/2003 the other one remaining controlled, in terms of management, benefits and financial risks, by the farmer originally managing the holding.
