Ter uitvoering van artikel 1, lid 4, punt i) 1.b), van Verordening (EEG) nr. 1576/89 wordt het maximumgehalte aan methylalcohol van eau-de-vie van rode en zwarte bessen (Ribes species), van lijsterbessen (Sorbus aucuparia) en van vlierbessen (Sambucus nigra) vastgesteld op 1 350 g per hectoliter alcohol 100 % en het maximumgehalte aan methylalcohol van eau-de-vie van frambozen (Rubus idaeus L.) en van braambessen (Rubus fruticosus L.) op 1 200 g per hectoliter alcohol 100 % vol.
Pursuant to Article 1 (4) (i) (1) (b) of Regulation (EEC) No 1576/89, the maximum methyl alcohol content of fruit spirits prepared from redcurrants and blackcurrants (Ribes species), service berries (Sorbus aucuparia) and elderberries (Sambucus nigra) shall be 1 350 g per hectolitre of alcohol at 100 % vol. and the maximum methyl alcohol content of fruit spirits prepared from raspberries (Rubus idaeus L.) and blackberries (Rubus fruticosus L.) shall be 1 200 g per hectolitre of alcohol at 100 % vol.

Overwegende dat in artikel 6 van Verordening (EEG) nr. 1014/90 van de Commissie van 24 april 1990 houdende uitvoeringsbepalingen voor de definitie, de aanduiding en de aanbiedingsvorm van gedistilleerde dranken (2), laatstelijk gewijzigd bij Verordening (EG) nr. 1712/95 (3), het maximumgehalte aan methylalcohol voor eau-de-vie van bepaalde vruchten op 1 500 gram per hectoliter alcohol 100 % vol is vastgesteld en ook dat de toepassing van deze bepaling door de Commissie zal worden geëvalueerd aan de hand van een grondige studie over de mogelijkheid dit maximumgehalte aan methylalcohol te verlagen;
Whereas Article 6 of Commission Regulation (EEC) No 1014/90 of 24 April 1990 laying down detailed implementing rules on the definition, description and presentation of spirit drinks (2), as last amended by Regulation (EC) No 1712/95 (3), raised the maximum methyl alcohol content of certain fruit spirits to 1 500 grams per hectolitre of alcohol at 100 % volume, subject to an evaluation of the application of this provision by the Commission on the basis of an in-depth study on whether the maximum methyl alcohol content can be reduced;

Overwegende dat in de door de Commissie uitgevoerde studie wordt beklemtoond dat enerzijds de mogelijkheid bestaat om het maximumgehalte aan methylalcohol te verlagen tot dichtbij het in Verordening (EEG) nr. 1576/89 voorgeschreven maximumgehalte voor eau-de-vie van vruchten, maar dat anderzijds een dergelijke verlaging moeilijk te verwezenlijken is, vooral door kleine distilleerderijen die over onvoldoende technische en financiële middelen beschikken om zich snel te kunnen aanpassen aan een verlaagd maximum; dat het om gezondheidsredenen evenwel dienstig is om te proberen het methanolgehalte voor alle soorten vruchten-eau-de-vie zo veel mogelijk te beperken; dat bijgevolg voorgesteld wordt om gespreid en trapsgewijs een nieuw maximumgehalte aan methylalcohol in te voeren voor de in artikel 6 van Verordening (EEG) nr. 1014/90 bedoelde eau-de-vie van vruchten;
Whereas the study carried out by the Commission demonstrates that it is possible to reduce the maximum methyl alcohol content to levels similar to those laid down for fruit spirits in Regulation (EEC) No 1576/89 although such a reduction would be difficult, particularly for small distilleries which do not have adequate technical and financial resources to comply quickly with a maximum limit fixed at a lower level; whereas it would be advisable for health reasons to reduce the methyl alcohol content of all fruit spirits to the lowest possible levels; whereas it is therefore proposed to introduce gradually and in stages a new maximum limit for the methyl alcohol content of the fruit spirits listed in Article 6 of Regulation (EEC) No 1014/90;
