Op 7 april 2008 heeft de Raad bij Besluit 2008/298/GBVB (1) Besluit 2001/80/GBVB van 22 januari 2001 houdende instelling van de Militaire Staf van de Europese Unie (2) gewijzigd, teneinde onder meer de taken van de Militaire Staf van de Europese Unie (EUMS) met betrekking tot het operatiecentrum van de EU te omschrijven.
On 7 April 2008, by Decision 2008/298/CFSP (1) the Council amended Decision 2001/80/CFSP of 22 January 2001 on the establishment of the Military Staff of the European Union (2) to specify, inter alia, the tasks of the Military Staff of the European Union (EUMS) in relation to the EU Operations Centre.

Onder voorbehoud van de voorschriften in dit hoofdstuk is de elders in dit besluit vervatte regeling eveneens van toepassing op militairen die overeenkomstig Besluit 2001/80/GBVB van de Raad van 22 januari 2001 houdende instelling van de Militaire Staf van de Europese Unie (5) bij de EDEO zijn gedetacheerd met het oog op de samenstelling van de Militaire Staf van de Europese Unie (EUMS).
Subject to the rules in this chapter, the rules laid down elsewhere in this Decision shall also apply to military staff seconded to the EEAS in order to form the European Union Military Staff (EUMS) pursuant to Council Decision 2001/80/CFSP of 22 January 2001 on the establishment of the Military Staff of the European Union (5), as amended.

Voor de leden van de Militaire Staf van de Europese Unie gelden de regels die zijn neergelegd in Besluit 2007/829/EG van de Raad van 5 december 2007 betreffende de regeling die van toepassing is op nationale deskundigen en militairen die bij het secretariaat-generaal van de Raad zijn gedetacheerd (3).
Members of the Military Staff of the European Union shall be subject to rules established in Council Decision 2007/829/EC of 5 December 2007 concerning the rules applicable to national experts and military staff on secondment to the General Secretariat of the Council (3).

Voorts kan de Raad, wat het uitvoeren van autonome militaire operaties betreft, in bepaalde omstandigheden op advies van het Militair Comité van de Europese Unie besluiten, gebruik te maken van de collectieve capaciteit van de Militaire Staf van de Europese Unie, met name wanneer een gezamenlijke civiel-militaire reactie vereist is en wanneer er geen nationaal hoofdkwartier is aangewezen.
Furthermore, regarding the conduct of autonomous military operations, in certain circumstances the Council may decide, upon the advice of the EU Military Committee, to draw on the collective capacity of the EUMS, in particular where a joint civil-military response is required and where no national Headquarters is identified.
