2. The relevant NCB or, where group data is reported to the ECB pursuant to Article 3a(5), the ECB, after consulting the relevant NCB, may grant derogations from the reporting requirements to group data reporting agents with respect to the flag “issuer is part of the reporting group (prudential scope)”, on a security-by-security basis, as set out in Article 3a(3), provided that the relevant NCB or the ECB, as applicable, is able to derive these data from data collected from other sources.

3. De desbetreffende NCB of, indien uit hoofde van artikel 3 bis, lid 5, groepsgegevens aan de ECB worden gerapporteerd, de ECB, na overleg met de betrokken NCB, kan werkelijke informatieplichtigen met een vrijstelling uit hoofde van dit artikel, artikel 4 of artikel 4 bis aanvullende rapportageverplichtingen opleggen, indien de desbetreffende NCB, of de ECB, al naargelang, nadere details noodzakelijk acht.
3. The relevant NCB, or where group data is reported to the ECB pursuant to Article 3a(5), the ECB, after consulting the relevant NCB, may make actual reporting agents, which have been granted derogations under this Article, Article 4 or 4a subject to additional reporting requirements, where further detail is deemed necessary by the relevant NCB or the ECB, as applicable.

De betrokken NCB of, indien uit hoofde van artikel 3 bis, lid 5, groepsgegevens aan de ECB worden gerapporteerd, de ECB, na overleg met de betreffende NCB, kan vrijstellingen verlenen van de rapportageverplichtingen uit hoofde van deze verordening, indien de werkelijke informatieplichtigen dezelfde gegevens rapporteren uit hoofde van: a) Verordening (EU) nr. 1071/2013 van de Europese Centrale Bank (ECB/2013/33) (*1); b) Verordening (EU) nr. 1073/2013 (ECB/2013/38); c) Verordening (EU) nr. 1075/2013 (ECB/2013/40), of d) Verordening (EU) nr. 1374/2014 (ECB/2014/50), of indien de desbetreffende NCB, of de ECB, al naargelang, dezelfde gegevens op een andere manier kunnen afleiden, zulks overeenkomstig de in bijlage III vastgestelde statistische minimumnormen.

The relevant NCB or, where group data is reported to the ECB pursuant to Article 3a(5), the ECB, after consulting the relevant NCB, may grant derogations from the reporting requirements under this Regulation if the actual reporting agents report the same data under: (a) Regulation (EU) No 1071/2013 of the European Central Bank (ECB/2013/33) (*1); (b) Regulation (EU) No 1073/2013 (ECB/2013/38); (c) Regulation (EU) No 1075/2013 (ECB/2013/40); or (d) Regulation (EU) No 1374/2014 (ECB/2014/50); or if the relevant NCB or the ECB, as applicable, are able to derive the same data by other means, in accordance with the minimum statistical standards specified in Annex III.

3. Gedurende een periode van twee jaar met ingang van de eerste rapportage overeenkomstig artikel 10 ter, lid 2, kan de betrokken NCB of, indien uit hoofde van artikel 3 bis, lid 5, groepsgegevens aan de ECB worden gerapporteerd, de ECB, na overleg met de betreffende NCB, aan groepsgegevens rapporterende informatieplichtigen vrijstellingen verlenen van de rapportageverplichtingen aangaande de entiteitsgewijze rapportage zoals bedoeld in bijlage I, hoofdstuk 2, voor entiteiten die buiten de Unie ingezeten zijn, mits de betreffende NCB, of de ECB, al naargelang, voor de buiten de Unie ingezeten entiteiten de gegevens van bijlage I, hoofdstuk 2, als geheel kunnen afleiden”.
3. For a period of two years from the first reporting in accordance with Article 10b(2), the relevant NCB, or, where group data is reported to the ECB pursuant to Article 3a(5), the ECB, after consulting the relevant NCB, may grant derogations from the reporting requirements to group data reporting agents with respect to the reporting on entity-by-entity basis set out in Chapter 2 of Annex I for entities resident outside the Union provided that the relevant NCB or the ECB, as applicable, are able to derive the information in Chapter 2 of Annex I for the entities resident outside the Union as a whole’.

NCBs shall be deemed to jointly control a legal person where the following cumulative conditions are fulfilled: (a) the decision-making bodies of the controlled legal person are composed of representatives of all participating NCBs; individual representatives may represent several or all of the participating NCBs; (b) those NCBs are able to jointly exert decisive influence over the strategic objectives and significant decisions of the controlled legal person; (c) the controlled legal person does not pursue any interests which are contrary to those of the controlling NCBs;

4. Wanner een NCB toetreedt tot het Eurosysteem, wordt het compenserende bedrag van die NCB toegedeeld aan de overige NCB's naar rato van de respectieve aandelen van de overige NCB's in de verdeelsleutel voor het geplaatste kapitaal, met omkering van het teken (+/–), welk compenserend bedrag voor de overige NCB's reeds geldende compenserende bedragen aanvult.
4. When an NCB joins the Eurosystem, its compensatory amount shall be allocated to the other NCBs in proportion to the respective shares of the other NCBs in the subscribed capital key, with the sign (+/–) reversed, and shall be in addition to any compensatory amounts already in force for the other NCBs.

The non-euro area NCBs participating in ERM II shall apply the payment after payment procedure when acting as correspondents of the euro area NCBs and the ECB in accordance with this Annex; the non-euro area NCBs participating in ERM II may, at their discretion, adopt the same payment after payment procedure when settling intervention at the margins that such NCBs have carried out on their own behalf.

Het verstrekken van eurobankbiljetten en –muntstukken door een NCB van het Eurosysteem aan een toekomstige NCB van het Eurosysteem vindt niet plaats voordat de verstrekkende NCB van het Eurosysteem en de ontvangende toekomstige NCB van het Eurosysteem zijn overeengekomen dat de in dit richtsnoer vastgelegde voorwaarden van toepassing zijn op de lening van eurobankbiljetten en –muntstukken aan de toekomstige NCB van het Eurosysteem, en dat derhalve deze voorwaarden zullen worden toegepast bij het uitwerken van de overeenkomsten voor bevoorrading vooraf en verdere bevoorrading vooraf.
3. The delivery of euro banknotes and coins by a Eurosystem NCB to a future Eurosystem NCB shall not take place before the delivering Eurosystem NCB and the receiving future Eurosystem NCB have concluded contractual arrangements stipulating that the conditions set out in this Guideline apply to the loan of euro banknotes and coins to the future Eurosystem NCB, and hence will be applied when establishing the arrangements for frontloading and sub-frontloading.
