REFERRING to the jurisdiction conferred to the Court of Justice of the European Communities pursuant to Article 68(1) of the Treaty establishing the European Community to give rulings on preliminary questions relating to the validity and interpretation of acts of the institutions of the Community based on Title IV of the Treaty, including the validity and interpretation of this Agreement, and to the circumstance that this provision shall not be binding upon or applicable in Denmark, as results from the Protocol on the position of Denmark.

De Commissie beklemtoont dat een mondiaal en op de markt gebaseerd mechanisme om een internationale prijs aan de koolstofemissie van de internationale luchtvaart te verbinden niet alleen het primaire doel van emissiereductie kan verwezenlijken maar ook kan bijdragen tot de financiering van internationale maatregelen met het oog op beperking van en aanpassing aan de klimaatverandering.

7. waarschuwt dat het voornemen om het permanente stabiliteitsmechanisme buiten het institutionele kader van de EU op te zetten de integriteit van het op het Verdrag gebaseerde systeem in gevaar brengt; is van mening dat de Commissie als lid van de raad van dit mechanisme moet deelnemen, en niet alleen maar als waarnemer; is voorts van mening dat de Commissie in dit verband de bevoegdheid moet krijgen om passende initiatieven te nemen om met instemming van de betrokken lidstaten de doelstellingen van het Europees stabiliteitsmechanisme te verwezenlijken; benadrukt dat de lidstaten hoe dan ook het Unierecht en de daarin bepaalde prerogatieven van de instellingen moeten naleven;
7. Warns that the intention to establish the permanent stability mechanism outside the EU institutional framework poses a risk to the integrity of the Treaty-based system; considers that the Commission must be a member of the board of this mechanism, and not simply an observer; considers, moreover, that in this context the Commission should be entitled to take the appropriate initiatives in order to achieve, with the consent of the Member States concerned, the objectives of the European stability mechanism; underlines that Member States must at any rate respect Union law and the prerogatives of the institutions laid down therein;

7. waarschuwt dat het voornemen om het permanente stabiliteitsmechanisme buiten het institutionele kader van de EU op te zetten de integriteit van het op het Verdrag gebaseerde systeem in gevaar brengt; is van mening dat de Commissie als lid van de raad van dit mechanisme moet deelnemen, en niet alleen maar als waarnemer; is voorts van mening dat de Commissie in dit verband de bevoegdheid moet krijgen om passende initiatieven te nemen om met instemming van de betrokken lidstaten de doelstellingen van het ESM te verwezenlijken; benadrukt dat de lidstaten hoe dan ook het Unierecht en de daarin bepaalde prerogatieven van de instellingen moeten naleven;
7. 8. herinnert eraan dat Verordening (EG) nr. 332/2002 vóór de huidige financiële moeilijkheden van Hongarije niet is toegepast sinds haar goedkeuring in 2002, en dat de verordening die daarvóór van kracht was, namelijk Verordening (EEG) nr. 1969/88 tot uitvoering van het in artikel 119 van het EG-Verdrag voorziene mechanisme, twee keer is toegepast, de eerste keer voor Griekenland in 1991 en de tweede keer voor Italië in 1993, en dat Griekenland en Italië hun verbintenissen tegenover de Commissie ten volle hebben nageleefd;
8. Recalls that, before Hungary's current financial difficulties Regulation (EC) No 332/2002 had not been applied since its adoption in 2002, and that its predecessor, Regulation (EEC) No 1969/88 implementing the mechanism foreseen by the Article 119 of the Treaty, was applied twice, once for Greece in 1991 and once for Italy in 1993, and that Greece and Italy have fully respected their commitments to the Commission;

4. verzoekt de Raad de artikelen 29 en 47 van het EU-Verdrag in acht te nemen die duidelijk stellen dat het EG-Verdrag voorrang heeft op het EU-Verdrag en dat een op Titel VI van het EU-Verdrag gebaseerd instrument niet kan worden goedgekeurd zolang het EG-Verdrag voldoende mogelijkheden biedt om dezelfde doelstelling te bereiken;
4. Calls on the Council to comply with Articles 29 and 47 of the Treaty on European Union, which clearly establish the primacy of the EC Treaty over the EU Treaty and hence the fact that an instrument based on Title VI of the EU Treaty cannot be adopted when the EC Treaty provides the possibility of achieving the same objective;

Het verdelen van de last van alle asielgevallen in de EU over de lidstaten is in de huidige politieke situatie niet realiseerbaar. Zoals ook aan het einde van hoofdstuk 3 gesteld, is het op de EU-regeling gebaseerde mechanisme dat door het UNHCR werd voorgesteld, waarbij de noodzaak van herverdeling tussen de EU-lidstaten waarschijnlijk minimaal zal zijn, evenwel de moeite waard om in overweging te nemen.
Whilst a burden-sharing of the total asylum caseload in the EU amongst the Member States does not seem feasible at this particular political juncture, however, as mentioned at the end of Chapter 3, the EU-based mechanism suggested by UNHCR, where the need for reallocation amongst the EU Member States is expected to be very minimal, is worthwhile giving further consideration.
