– having regard to the 112 single European emergency phone number for the European Union, established by Council Decision of 29 July 1991 (91/396/EEC), reinforced by Directive 98/10/EC on the application of open network provision (ONP) to voice telephony and on universal service for telecommunications in a competitive environment,

Om de continuïteit van de bestaande afspraken te waarborgen en te voorkomen dat een rechtsvacuüm ontstaat, moet ervoor worden gezorgd dat de verplichtingen inzake toegang en interconnectie krachtens de artikelen 4, 6, 7, 8, 11, 12 en 14 van Richtlijn 97/33/EG van het Europees Parlement en de Raad van 30 juni 1997 inzake interconnectie op telecommunicatiegebied wat betreft de waarborging van de universele dienst en van de interoperabiliteit door toepassing van de beginselen van Open Network Provision (ONP) , de verplichtingen inzake bijzondere netwerktoegang krachtens artikel 16 van Richtlijn 98/10/EG van het Europees Parlement en de Raad van 26 februari 1998 inzake de toepassing van Open Network Provision (ONP) op spraaktelefonie en inzake de universele telecommunicatiedienst in een door concurrentie gekenmerkt klimaat , en de verplichtingen inzake het beschikbaar stellen van transmissiecapaciteit voor huurlijnen krachtens Richtlijn 92/44/EEG van de Raad van 5 juni 1992 betreffende de toepassing van Open Network Provision (ONP) op huurlijnen , in een eerste stadium in het nieuwe regelgevingskader worden overgenomen, zij het met de mogelijkheid deze onmiddellijk te herzien in het licht van de heersende marktomstandigheden.
In order to ensure continuity of existing agreements and to avoid a legal vacuum, it is necessary to ensure that obligations for access and interconnection imposed under Articles 4, 6, 7, 8, 11, 12, and 14 of Directive 97/33/EC of the European Parliament and of the Council of 30 June 1997 on interconnection in telecommunications with regard to ensuring universal service and interoperability through application of the principles of open network provision (ONP) , obligations on special access imposed under Article 16 of Directive 98/10/EC of the European Parliament and of the Council of 26 February 1998 on the application of open network provision (ONP) to voice telephony and on universal service for telecommunications in a competitive environment , and obligations concerning the provision of leased line transmission capacity under Council Directive 92/44/EEC of 5 June 1992 on the application of open network provision to leased lines , are initially carried over into the new regulatory framework, but are subject to immediate review in the light of prevailing market conditions.

Until the Communications Committee is established pursuant to Decision 1999/468/EC, the Commission shall be assisted by the Committee established by Article 9 of Council Directive 90/387/EEC of 28 June 1990 on the establishment of the internal market for telecommunication services through the implementation of open network provision(7).

Member States have already notified to the Commission the names of those fixed public network operators which have significant market power under Annex I, Part 1, of Directive 97/33/EC of the European Parliament and of the Council of 30 June 1997 on interconnection in telecommunications with regard to ensuring universal service and interoperability through application of the principles of open network provision (ONP)(3), and Directive 98/10/EC of the European Parliament and of the Council of 26 February 1998 on the application of open network provision to voice telephony and on universal service for telecommunications in a competitive environment(4).
