2. Calls on the Commission, as a matter of urgency, to clarify the scope and interpretation of Directive 98/44/EC, and in particular Articles 4, 12(3)(b) and 13(3)(b) thereof, in order to ensure legal clarity regarding the prohibition of the patentability of products obtained from essentially biological processes, and to clarify that breeding with biological material falling under the scope of a patent is permitted;

2. verzoekt de Commissie dringend om verduidelijking van de reikwijdte en uitlegging van Richtlijn 98/44/EG, en met name artikel 4, artikel 12, lid 3, onder b), en artikel 13, lid 3, onder b), teneinde te zorgen voor rechtszekerheid omtrent het verbod op de octrooieerbaarheid van via werkwijzen van wezenlijk biologische aard verkregen producten en voor verduidelijking inzake de toelaatbaarheid van kweken met biologisch materiaal dat onder een octrooi valt;
