TRADUCTIONS EN CONTEXTE

Het "Statement of Registrar Accreditation Policy" van de ICANN, waarin met name het Registrars Accreditation Agreement is opgenomen, bevat bepalingen betreffende het verstrekken van persoonlijke gegevens (en andere gegevens) door de domeinnaamaanvrager aan de Registrar, die de gegevens dan doorgeeft aan de Whois-databases (zie bijlage bij deze mededeling).
The ICANN "Statement of Registrar Accreditation Policy" including in particular the Registrars Accreditation Agreement, contains provisions requiring the domain name applicant to give personal data (and other data) to the Registrar which forwards the data to the Registry and their Whois databases (see annex to this Communication).

In het licht van Richtlijn 95/46/EG van het Europees Parlement en de Raad en Verordening (EG) nr. 45/2001 van het Europees Parlement en de Raad moeten de Commissie en de lidstaten, met betrekking tot de op grond van de onderhavige verordening verstrekte gegevens, ongeoorloofde mededeling van of toegang tot persoonsgegevens voorkomen.
In light of Directive 95/46/EC of the European Parliament and of the Council and Regulation (EC) No 45/2001 of the European Parliament and of the Council , the Commission and the Member States should, in relation to the information provided pursuant to this Regulation, prevent any unauthorised disclosure of, or access to, personal data.

It is necessary to provide, in relation to the audit work pursuant to Regulation (EU) No 1303/2013, that the Commission and the Member States should prevent any unauthorised disclosure of or access to personal data, and to specify the purposes for which the Commission and the Member States can process such data.

1. De lidstaten schrijven voor dat de bevoegde autoriteiten passende technische en organisatorische maatregelen treffen om persoonsgegevens te beveiligen tegen onbedoelde of onrechtmatige vernietiging, tegen wijziging, ongeoorloofde mededeling of toegang, met name indien de verwerking verzending van gegevens via een netwerk of beschikbaarstelling via directe geautomatiseerde toegang omvat, en tegen alle andere vormen van onrechtmatige verwerking, waarbij met name rekening wordt gehouden met de risico’s van de verwerking en de aard van de te beschermen gegevens.
1. Member States shall provide that the competent authorities must implement appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access, in particular where the processing involves the transmission over a network or the making available by granting direct automated access, and against all other unlawful forms of processing, taking into account in particular the risks represented by the processing and the nature of the data to be protected.
