Krachtens artikel III-173 van de ontwerp-grondwet kunnen bij Europese wet of kaderwet maatregelen worden vastgesteld ter stimulering en ondersteuning van het optreden van de lidstaten op het gebied van misdaadpreventie, wat van groot belang is voor de wijzen van tenuitvoerlegging van vrijheidsstraffen en alternatieve straffen (zie bijlagen I en II).
Under Article III-173 of the Draft Constitution, European laws or framework laws may establish measures to promote and support the action of Member States in the field of crime prevention, which is important for the implementation of custodial sentences and alternative sanctions (Annexes I and II).

Overeenkomstig artikel III-171, lid 1, tweede alinea, onder d), van de ontwerp-grondwet kunnen bij Europese wet of kaderwet maatregelen worden vastgesteld om "in het kader van strafvervolging en tenuitvoerlegging van beslissingen de samenwerking tussen de justitiële of gelijkwaardige autoriteiten van de lidstaten te bevorderen".
By point 2(d) of the second subparagraph of Article III-171(1) of the Draft Constitution, European laws or framework laws shall establish measures to "facilitate cooperation between judicial or equivalent authorities of the Member States in relation to proceedings in criminal matters and the enforcement of decisions".
