1. Wanneer een oorsprongsbenaming of een geografische aanduiding overeenkomstig deze verordening wordt beschermd, wordt een aanvraag tot registratie van een merk dat onder één van de in artikel 45, lid 2, vermelde situaties valt en dat betrekking heeft op een product van één van de in bijlage IV vermelde categorieën, afgewezen als de aanvraag tot bescherming van het merk wordt ingediend na de datum waarop de aanvraag tot bescherming van de oorsprongsbenaming of de geografische aanduiding bij de Commissie is ingediend, en wordt de oorsprongsbenaming of geografische aanduiding vervolgens beschermd.
1. Where a designation of origin or a geographical indication is protected under this Regulation, the registration of a trademark corresponding to one of the situations referred to in Article 45(2) and relating to a product falling under one of the categories listed in Annex IV shall be refused if the application for registration of the trademark is submitted after the date of submission of the application for protection of the designation of origin or geographical indication to the Commission and the designation of origin or geographical indication is subsequently protected.

In its judgment today, the Court rules that the Regulation on the protection of geographical indications and designations of origin is exhaustive in nature, with the result that it precludes the application of a system of protection laid down by agreements between two Member States, such as the bilateral instruments at issue, which confers on a designation, recognised under the law of a Member State as constituting a designation of origin, protection in another Member State where that protection is actually claimed despite the fact that no application for registration of that designation of origin has been made in accordance with that regulation.

Volgens de handelsrechtbank moet de benaming „Bud” echter eerder als een oorsprongsbenaming worden gekwalificeerd, die producten aanduidt waarvan de bijzonderheden zijn toe te schrijven aan factoren van natuurlijke of menselijke aard van hun plaats van herkomst.
Nevertheless, in the view of the Commercial Court, the designation ‘Bud’ must rather be classified as a designation of origin covering goods whose specific features can be attributed to natural or human factors inherent in their place of provenance.

Voor producten waarvan de oorsprongsbenaming beschermd is (beschermde oorsprongsbenaming - BOB, beschermde geografische aanduiding - BGA, gegarandeerde traditionele specialeit - GTS) en door de EU is geregistreerd, verzet de Commissie zich in het algemeen niet tegen subsidies voor advertenties waarin naar de oorsprong van het betrokken product wordt verwezen, op voorwaarde dat die verwijzing exact overeenkomt met de benaming die is geregistreerd.
In the case of products bearing a protected designation of origin (Protected Designation of Origin - PDO, Protected Geographical Indication - PGI, Traditional Speciality Guaranteed - TSG) registered by the EU, the Commission in general does not oppose advertising aids which include a reference to the origin of the product concerned, provided that it corresponds exactly to those which have been registered.
