overwegende dat de procureur-generaal van de Republiek Polen een verzoek heeft doorgezonden van de Poolse inspecteur-generaal voor het wegvervoer om opheffing van de immuniteit van Bolesław G. Piecha, lid van het Europees Parlement, wegens het strafbare feit bedoeld in artikel 92a van het wetboek van overtredingen van 20 mei 1971 juncto artikel 20, lid 1, van de wegenverkeerswet van 20 juni 1997, dat het hier concreet gaat om overschrijding van de maximumsnelheid binnen de bebouwde kom.
whereas the Prosecutor-General of the Republic of Poland has forwarded a request from the Polish General Inspector of Road Transport for waiver of the immunity of Bolesław G. Piecha, a Member of the European Parliament elected to represent a constituency in Poland, concerning an offence under Article 92a of the Code of Petty Offences of 20 May 1971 in conjunction with Article 20(1) of the Road Traffic Act of 20 June 1997; whereas, in particular, the alleged offence involves exceeding the permitted speed limit in a built-up area.

gezien het verzoek om opheffing van de immuniteit van Bolesław G. having regard to the request for waiver of the immunity of Bolesław G. Piecha, forwarded on 29 October 2015 by the Prosecutor-General of the Republic of Poland in connection with proceedings to be brought by the Polish General Inspector of Road Transport (Główny Inspektor Transportu Drogowego) (reference No CAN-PST-SCW.7421.653220.2014.13.A.0475), and announced in plenary on 23 November 2015,

B. overwegende dat de permanente vertegenwoordiger van de Republiek Kroatië bij de EU de Voorzitter van het Parlement bij schrijven van 14 februari 2014 heeft medegedeeld dat er geen specifieke procedurele regels bestaan voor verzoeken om opheffing van de immuniteit van Kroatische leden van het Europees Parlement en dat derhalve de bepalingen inzake verzoeken om opheffing van de immuniteit van leden van het Kroatische parlement moeten worden toegepast, en dat volgens die bepalingen een bevoegde overheidsinstantie, de benadeelde partij als eiser en een particuliere eiser gerechtigd zijn een verzoek in te dienen om toestemming voor voorlopige hechtenis of om inleiding van een strafprocedure tegen een parlementslid;
B. whereas by letter of 14 February 2014 the Permanent Representative of the Republic of Croatia to the EU informed the President of Parliament that, failing specific procedural rules with regard to the request for waiver of the immunity of Croatian Members of the European Parliament, the provisions governing the requests for waiver of immunity of Members of the national Parliament should apply and that, under those provisions, the request for approval of pre-trial detention (remand) or for initiation of criminal proceedings against a Member may be made by any authorised state body, the injured party as plaintiff or a private plaintiff;

Bij schrijven van 14 februari 2014 - dus vóór het begin van de lopende zittingsperiode en voordat het verzoek om opheffing van de immuniteit van de heer Jakovčić werd ingediend - heeft de permanente vertegenwoordiger van de Republiek Kroatië bij de EU de Voorzitter van het Parlement in antwoord op een verzoek om inlichtingen aan alle lidstaten laten weten dat er geen specifieke procedurele regels bestaan voor verzoeken om opheffing van de immuniteit van Kroatische leden van het Europees Parlement en dat derhalve de bepalingen inzake verzoeken om opheffing van de immuniteit van leden van het Kroatische parlement moeten worden toegepast.
By letter of 14 February 2014 – i.e. before the current legislative term started and the request for the waiver of Mr Jakovčić’s immunity was actually made –, in reply to an enquiry sent to all Member States, the Permanent Representative of the Republic of Croatia to the EU had informed the President of Parliament that, failing specific procedural rules with regard to the request for waiver of the immunity of the Croatian Members of the European Parliament, the provisions governing the requests for waiver of immunity of the Members of the national Parliament should apply.

1. is van oordeel dat het verzoek om opheffing van de immuniteit van de heer Jakovčić door de bevoegde autoriteit is ingediend in de zin van artikel 9, lid 1, van het Reglement, en dat het derhalve ontvankelijk is; is voorts van oordeel dat er in het licht van artikel 9, lid 2, van het Reglement aan het Parlement geen termijn kan worden gesteld aan de besluitvorming over een verzoek om opheffing van de immuniteit;

Considers that the request for the waiver of the immunity of Mr Jakovčić has been submitted by the competent authority within the meaning of Rule 9(1) of the Rules of Procedure and that, on this ground, it is to be deemed admissible; considers, furthermore, that, in the light of Rule 9(2) of its Rules of Procedure, no deadline can be imposed on Parliament for reaching a decision on a request for waiver of immunity;
