Overeenkomstig het Verdrag van Genève betreffende de status van vluchtelingen uit 1951 geldt als vluchteling elke persoon die ,uit gegronde vrees voor vervolging wegens zijn ras, godsdienst, nationaliteit, het behoren tot een bepaalde sociale groep of zijn politieke overtuiging, zich bevindt buiten het land waarvan hij de nationaliteit bezit, en die de bescherming van dat land niet kan of, uit hoofde van bovenbedoelde vrees, niet wil inroepen".
In accordance with the 1951 Geneva Convention relating to the Status of Refugees, a refugee is a person "who owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group, or political opinion, is outside the country of his nationality, and is unable to or, owing to such fear, is unwilling to avail himself of the protection of that country..".

52. verzoekt de Unie de initiatieven van de internationale gemeenschap te steunen die tot doel hebben de begrippen politiek vluchteling, economisch vluchteling en milieuvluchteling te verduidelijken en aan elke categorie aangepaste bescherming en hulp te bieden; is van mening dat ontheemden dezelfde bescherming als vluchtelingen dienen te genieten, zoals in het Verdrag betreffende de status van vluchtelingen van 28 juli 1951 is bepaald; verzoekt de lidstaten en de internationale gemeenschap te waken over de naleving van de "richtsnoeren inzake interne verplaatsingen" (Guiding Principles on Internal Displacement) van de Verenigde Naties en beveelt aan deze normen ter bescherming van ontheemden in een internationaal verdrag te bekrachtigen;
52. Calls for the Union to support the initiatives of the international community aimed at clarifying the concepts of political, economic and environmental refugees and to provide each category with suitable protection and assistance; considers that displaced persons should receive the same level of protection as that provided for refugees under the Convention relating to the Status of Refugees of 28 July 1951; calls on the states and on the international community to ensure respect for the UN’s Guiding Principles on Internal Displacement and recommends that these guidelines on the protection of displaced persons be enshrined in an international convention;

53. verzoekt de Unie de initiatieven van de internationale gemeenschap te steunen die tot doel hebben de begrippen politiek vluchteling, economisch vluchteling en milieuvluchteling te verduidelijken en aan elke categorie aangepaste bescherming en hulp te bieden; is van mening dat ontheemden dezelfde bescherming als vluchtelingen dienen te genieten, zoals in het Verdrag betreffende de status van vluchtelingen van 28 juli 1951 is bepaald; verzoekt de lidstaten en de internationale gemeenschap te waken over de naleving van de "richtsnoeren inzake interne verplaatsingen" (Guiding Principles on Internal Displacement) van de Verenigde Naties en beveelt aan deze normen ter bescherming van ontheemden in een internationaal verdrag te bekrachtigen;
53. 2. Considers that Member States should grant political refugee status to persons who fully satisfy the conditions required by the Geneva Convention, without restricting the scope of the Convention at national level purely because illegal economic migrants may claim to be victims of political persecution.

„vluchteling”: een onderdaan van een derde land die zich wegens een gegronde vrees voor vervolging om redenen van ras, godsdienst, nationaliteit, politieke overtuiging of het behoren tot een bepaalde sociale groep, buiten het land bevindt waarvan hij de nationaliteit bezit en de bescherming van dat land niet kan of, wegens deze vrees, niet wil inroepen, dan wel een staatloze die zich om dezelfde reden buiten het land bevindt waar hij vroeger gewoonlijk verbleef en daarheen niet kan, dan wel wegens genoemde vrees niet wil terugkeren, en op wie artikel 12 niet van toepassing is.
‘refugee’ means a third country national who, owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, political opinion or membership of a particular social group, is outside the country of nationality and is unable or, owing to such fear, is unwilling to avail himself or herself of the protection of that country, or a stateless person, who, being outside of the country of former habitual residence for the same reasons as mentioned above, is unable or, owing to such fear, unwilling to return to it, and to whom Article 12 does not apply.

[20] De bepalingen van dit Verdrag zijn niet van toepassing op een persoon ten aanzien van wie er ernstige redenen zijn om te veronderstellen, dat: (a) hij een misdrijf tegen de vrede, een oorlogsmisdrijf of een misdrijf tegen de menselijkheid heeft begaan, zoals omschreven in de internationale overeenkomsten welke zijn opgesteld om bepalingen met betrekking tot deze misdrijven in het leven te roepen; (b) hij een ernstig, niet-politiek misdrijf heeft begaan buiten het land van toevlucht, voordat hij tot dit land als vluchteling is toegelaten; (c) hij zich schuldig heeft gemaakt aan handelingen welke in strijd zijn met de doelstellingen en beginselen van de Verenigde Naties.
[20] The provisions of this Convention shall not apply to any person with respect to whom there are serious reasons for considering that: (a) he has committed a crime against peace, a war crime, or a crime against humanity, as defined in the international instruments drawn up to make provision in respect of such crimes; (b) he has committed a serious non-political crime outside the country of refuge prior to his admission to that country as a refugee; (c) he has been guilty of acts contrary to the purposes and principles of the United Nations.
