De Commissie heeft, overeenkomstig haar mededeling van 14 december 1993 inzake de tenuitvoerlegging van de overeenkomst betreffende de sociale politiek, het Europees Parlement en het Economisch en Sociaal Comité op de hoogte gebracht door hun de tekst van het voorstel met daarin de tekst van de overeenkomst te doen toekomen.
The Commission has informed the European Parliament and the European Economic and Social Committee, in accordance with its communication of 14 December 1993 concerning the application of the Agreement on Social Policy, by sending them the text of its proposal for a Directive containing the Agreement.

EROP WIJZEND dat deze overnameovereenkomst geen afbreuk doet aan de rechten, verplichtingen en verantwoordelijkheden van de Gemeenschap, de lidstaten van de Europese Unie en de Russische Federatie die voortvloeien uit het internationaal recht, waaronder de internationale wetgeving inzake mensenrechten, en met name uit de Universele Verklaring van de rechten van de mens van 10 december 1948; het Internationaal Verdrag inzake burgerrechten en politieke rechten van 16 december 1966; het Verdrag betreffende de status van vluchtelingen van 28 juli 1951 en het Protocol betreffende de status van vluchtelingen van 31 januari 1967; het Europees Verdrag tot bescherming van de rechten van de mens en de fundamentele vrijheden van 4 november 1950 en Protocol nr. 4 van 16 september 1963 daarbij en het Verdrag tegen foltering en andere wrede, onmenselijke of onterende behandeling of bestraffing van 10 december 1984,
EMPHASIZING that this Agreement shall be without prejudice to the rights, obligations and responsibilities of the Community, the Member States of the European Union and the Russian Federation arising from International Law including International Human Rights law rules, as confirmed, in particular, by the Universal Declaration of Human Rights of 10 December 1948, the International Covenant on Civil and Political Rights of 16 December 1966, the Convention relating to the Status of Refugees of 28 July 1951 and the Protocol relating to the Status of Refugees of 31 January 1967, the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 and Protocol No 4 thereto of 16 September 1963, and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment of 10 December 1984,

Having regard to the Agreement on social policy annexed to the Protocol on social policy attached to the Treaty establishing the European Community and in particular Articles 3(4) and 4(2) thereof;

1. Gelet op de Overeenkomst betreffende de sociale politiek bij het protocol betreffende de sociale politiek, dat is gehecht aan het Verdrag betreffende de Europese Unie, inzonderheid op artikel 3, lid 4, en artikel 4, lid 2;

EVV, Unice en CEEP verzoeken de Commissie deze raamovereenkomst aan de Raad voor te leggen voor een besluit waardoor deze voorschriften verbindend worden in de lidstaten die partij zijn bij de Overeenkomst betreffende de sociale politiek, die is gehecht aan het protocol betreffende de sociale politiek bij het Verdrag betreffende de Europese Unie.
ETUC, UNICE and CEEP request the Commission to submit this Framework Agreement to the Council for a decision making these requirements binding in the Member States which are party to the Agreement on social policy annexed to the Protocol (No 14) on social policy annexed to the Treaty establishing the European Community.

(1) Overwegende dat op grond van het aan het Verdrag gehechte Protocol betreffende de sociale politiek, de lidstaten, met uitzondering van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland (hierna de "lidstaten" te noemen), geleid door de wens het Sociaal Handvest van 1989 uit te voeren, een overeenkomst betreffende de sociale politiek hebben gesloten;
(1) Whereas, on the basis of the Protocol on social policy annexed to the Treaty, the Member States, with the exception of the United Kingdom of Great Britain and Northern Ireland (hereinafter called 'the Member States`), wishing to implement the 1989 Social Charter, have concluded an Agreement on social policy;

VERWIJZENDE naar de beginselen van het Handvest van de Verenigde Naties en herinnerende aan de Universele Verklaring van de Rechten van de Mens, de conclusies van de Conferentie van Wenen van 1993 over de mensenrechten, het Internationaal Verdrag inzake burgerrechten en politieke rechten, het Internationaal Verdrag inzake economische, sociale en culturele rechten, de Overeenkomst inzake de rechten van het kind, het Verdrag inzake de uitbanning van alle vormen van discriminatie van vrouwen, het Internationaal Verdrag inzake de uitbanning van alle vormen van rassendiscriminatie, de Verdragen van Genève van 1949 en andere instrumenten van het internationale humanitaire recht, het Verdrag betreffende de status van staatlozen (Genève 1954), het Verdrag betreffende de status van vluchtelingen (Genève 1951) en het Protocol betreffende de status van vluchtelingen (New York 1967).
REFERRING to the principles of the Charter of the United Nations, and recalling the Universal Declaration of Human Rights, the conclusions of the 1993 Vienna Conference on Human Rights, the Covenants on Civil and Political Rights and on Economic, Social and Cultural Rights, the Convention on the Rights of the Child, the Convention on the Elimination of all forms of Discrimination against Women, the International Convention on the Elimination of all forms of Racial Discrimination, the 1949 Geneva Conventions and the other instruments of international humanitarian law, the 1954 Convention relating to the status of stateless persons, the 1951 Geneva Convention relating to the Status of Refugees and the 1967 New York Protocol relating to the Status of Refugees.

Overwegende dat op basis van het Protocol betreffende de sociale politiek dat aan het Verdrag tot oprichting van de Europese Gemeenschap is gehecht, het Koninkrijk België, het Koninkrijk Denemarken, de Bondsrepubliek Duitsland, de Helleense Republiek, het Koninkrijk Spanje, de Franse Republiek, Ierland, de Italiaanse Republiek, het Groothertogdom Luxemburg, het Koninkrijk der Nederlanden en de Portugese Republiek, hierna "Lid-Staten" genoemd, het Sociaal Handvest van 1989 ten uitvoer wensen te leggen en hiertoe een Overeenkomst betreffende de sociale politiek hebben vastgesteld;
Whereas, on the basis of the Protocol on Social Policy annexed to the Treaty establishing the European Community, the Kingdom of Belgium, the Kingdom of Denmark, the Federal Republic of Germany, the Hellenic Republic, the Kingdom of Spain, the French Republic, Ireland, the Italian Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Portuguese Republic (hereinafter referred to as 'the Member States'), desirous of implementing the Social Charter of 1989, have adopted an Agreement on Social Policy;
