5. Paragraph 3 shall not preclude Article 36(2) and Articles 37 to 43 from being applicable with respect to the auctions of allowances in the form of two-day spot or five-day futures that are not a financial instrument within the meaning of Article 1(3) of Directive 2003/6/EC conducted by an auction platform appointed pursuant to Article 26(2) or 30(2) where the Member State where the auction platform is established has implemented Article 43 of this Regulation or where such implementation is not necessary for the application of Article 43 of this Regulation’.

Stresses that the reform of the Common Fisheries Policy must be ambitious in order to achieve sustainable and healthy long-term fish stocks; urges the Commission to ensure that Article 43(2) of the Treaty on the Functioning of the European Union (TFEU) is the legal basis for its proposals and to limit the use of Article 43(3) to proposals strictly connected to the setting and allocation of fishing opportunities; recalls its opposition to the practice of discards and to ill-judged and costly measures aimed at reducing fleet capacity;

Stresses that any power of the Council to adopt measures pursuant to Article 43(3) of the TFEU is subject to the prior adoption, in accordance with the ordinary legislative procedure, of a legislative act pursuant to Article 43(2) of the TFEU, which prescribes the conditions and limitations attaching to the powers conferred on the Council; takes the view that Article 43(3) of the TFEU does not provide for a legal basis or for any autonomous power which would allow the adoption or amendment of any of the Council acts presently in force in the field of the CAP; calls on the Council to refrain from adopting any of the measures referred to in Article 43(3) of the TFEU without prior consultation of Parliament;
