2. Ingeval in een lidstaat de afwikkelingsfinancieringsregeling met betrekking tot een in artikel 45, lid 3, van Richtlijn 2014/59/EU bedoelde instelling voor enigerlei van de in artikel 101 van Richtlijn 2014/59/EU vermelde doeleinden wordt gebruikt, kan de afwikkelingsautoriteit een met redenen besluit vaststellen waarin is bepaald dat de artikelen 5, 6, 7, 8 en 9 van toepassing zijn op de betrokken instellingen die een risicoprofiel hebben dat vergelijkbaar is met of hoger is dan het risicoprofiel van de instelling die de afwikkelingsfinancieringsregeling voor enigerlei van de in artikel 101 van Richtlijn 2014/59/EU vermelde doeleinden heeft gebruikt.
2. In case the resolution financing arrangement is used with regard to an institution referred to in Article 45(3) of Directive 2014/59/EU in a Member State for any of the purposes referred to in Article 101 of Directive 2014/59/EU, the resolution authority may adopt a reasoned decision determining that Articles 5, 6, 7, 8 and 9 apply to those institutions which have a risk profile that is similar or above the risk profile of the institution which has used the resolution financing arrangement for any of the purposes referred to in Article 101 of Directive 2014/59/EU.

Deplores the fact that the poor implementation of Directive 96/59/EC is mainly due to the failure to draw up an inventory of existing PCBs particularly as such an inventory is an essential prerequisite of their disposal; criticises the fact that no analysis foresaw these difficulties; notes that, for the purposes of implementing this Directive, some Member States have resorted to financial incentives to encourage the declaration of PCBs by economic operators and hence the drawing up of inventories; accordingly asks the Commission to carry out an urgent revision of Directive 96/59/EC and in so doing to make provision for the use of such incentives, particularly for SMEs;
