Recognises the need for independent analysis of Member States’ economic perspectives at the EU level; in this context, urges the further development of the Commission’s Chief Economic Analyst Unit with a view to providing objective, independent and transparent analysis of the relevant data, which should be made public and should serve as a basis for well-informed debate and decision-making in the Commission, the Council and Parliament; demands that the Chief Economic Analyst Unit be forwarded all relevant documents in time to be able to carry out its tasks; stresses the useful role of national fiscal councils at both national and at EU level, and encourages the setting-up of a European network of independent national fiscal councils;

As regards the ‘transfer of a part of a business’, does European Union legislation (in particular, Article 1(1)(a) and (b) of Council Directive 2001/23/EC (1) of 12 March 2001, read in conjunction with Article 3(1) thereof) preclude a rule of national law, such as that laid down in the fifth paragraph of Article 2112 of the [Italian] Civil Code, which permits the transferee to take over the employment relationships of the transferor, without the consent of the employees transferred being necessary, even where the part of the business transferred is not a functionally independent economic entity already existing before the transfer and identifiable as such by the transferor and the transferee at the time when it is transferred?

Consequently, this heritage sometimes provides reference points and legitimacy, even today, for the most contradictory systems of ideas. It is well known to what extent the Arab world is marked by recurrent fragmentation in spite of the desires and attempts – whether utopian or realistic, even in very recent history – to achieve total or partial unity: Syrian-Egyptian unity, the AMU, the 1957 commission on Arab economic unity, the ambitions of the Baath party, the dreams of Libya.

This is further confirmed by the fact that (i) ÖIAG and the companies in which it has a stake do not appear to form an economic unit for the purposes of European competition law and (ii) under Council Regulation (EC) No 139/2004 of 20 January 2004 on the control of concentrations between undertakings (the EC Merger Regulation) (42), the Commission does not consider ÖIAG to be a group for the purposes of calculating the turnover thresholds.

Notes the limited progress made in liberalising inter-Arab trade and in strengthening the private sector; calls on the Commission and the Council to redouble their efforts to encourage the sustainable and equitable economic development of the Arab countries, seeking to reduce inequalities through structural and social policies which limit the harmful social effects of economic reforms; supports the economic integration of the Arab countries, particularly in essential markets such as energy and telecommunications, with a view to generating a dynamic development process which will favour other sectors, and at the same time putting in place policies aimed at encouraging reform, subject to precise and limited technical and political conditions; welcomes the efforts made to create a Euro-Mediterranean Free Trade Area and welcomes the Agadir Agreement, which promotes intra-regional trade; awaits the conclusion of the EU-Gulf Cooperation Council Free Trade Agreement;

These guidelines apply to the most common types of horizontal co-operation agreements irrespective of the level of integration they entail with the exception of operations constituting a concentration within the meaning of Article 3 of Council Regulation (EC) No 139/2004 of 20 January 2004 on the control of concentrations between undertakings (2) (‘the Merger Regulation’) as would be the case, for example, with joint ventures performing on a lasting basis all the functions of an autonomous economic entity (‘full-function joint ventures’) (3).

(9) De Raad stelt zich evenwel achter de conclusie van de Commissie volgens welke eveneens rekening gehouden dient te worden met de verkoopprijzen die worden gehanteerd door de binnenlandse verkoopmaatschappijen van deze firma, in zoverre de firma NSK en haar verkoopmaatschappijen - die zoals in Verordening (EEG) nr. 2516/86 is vermeld, volledig ondergeschikt zijn aan NSK en taken vervullen die in wezen overeenkomen met die van een verkoopkantoor of van een verkoopdienst - een en dezelfde economische eenheid vormen.
(9) However, the Council confirms the conclusion drawn by the Commission, namely that the prices charged by the company's domestic sales subsidiaries should likewise be taken into account as NSK and its sales subsidiaries - which, as was stated in Regulation (EEC) No 2516/86, are wholly owned by NSK and perform functions which correspond essentially to those of a sales subsidiary or sales department - form a single economic unit.
