4. In afwijking van de leden 2 en 3 kan, op voorwaarde dat het recht op een eerlijk proces hierdoor niet wordt geschonden, de toegang tot bepaalde stukken worden geweigerd indien door die toegang het leven of de grondrechten van een andere persoon ernstig in het gedrang zouden kunnen komen of indien die weigering strikt noodzakelijk is ter bescherming van een zwaarwegend algemeen belang, zoals wanneer door de toegang een lopend onderzoek zou kunnen worden geschaad of de nationale veiligheid van de lidstaat waar de strafprocedure wordt gevoerd ernstig zou kunnen worden bedreigd.
4. By way of derogation from paragraphs 2 and 3, provided that this does not prejudice the right to a fair trial, access to certain materials may be refused if such access may lead to a serious threat to the life or the fundamental rights of another person or if such refusal is strictly necessary to safeguard an important public interest, such as in cases where access could prejudice an ongoing investigation or seriously harm the national security of the Member State in which the criminal proceedings are instituted.

De in deze richtlijn bedoelde toegang tot de stukken van het dossier dient kosteloos te zijn; dit laat onverlet de bepalingen in het nationale recht die voorzien in de betaling van kosten voor kopieën van documenten uit het dossier of voor verzending van stukken aan de betrokkenen of hun advocaat.
