5. wijst erop dat wederzijds gewenste seksuele contacten tussen volwassenen van hetzelfde geslacht wel legaal zijn in Burkina Faso, Benin, Tsjaad, de Centraal-Afrikaanse Republiek, Congo, de Democratische Republiek Congo, Equatoriaal Guinea, Gabon, Guinee-Bissau, Ivoorkust, Madagascar, Mali, Niger, Rwanda en Zuid-Afrika, en dat discriminatie op grond van seksuele gerichtheid in de Zuid-Afrikaanse grondwet wordt verboden, waaruit blijkt dat de opvattingen in Afrika over dit onderwerp uiteenlopen;
