TRADUCTIONS EN CONTEXTE

Door niet naar behoren te hebben vastgesteld welke wateren zouden kunnen worden beïnvloed door verontreiniging door nitraten uit agrarische bronnen, door niet naar behoren de kwetsbare zones te hebben aangewezen, en door actieprogramma’s op te stellen in de zin van artikel 5 van richtlijn 91/676/EEG van de Raad van 12 december 1991 inzake de bescherming van water tegen verontreiniging door nitraten uit agrarische bronnen, die maatregelen bevatten die niet in overeenstemming zijn met deze richtlijn, is de Republiek Polen de verplichtingen niet nagekomen die op haar rusten op grond van artikel 3, gelezen in samenhang met bijlage I bij richtlijn 91/676, en artikel 5, gelezen in samenhang met bijlage II, A, punt 2, en bijlage III, eerste paragraaf, punt 1, bij deze richtlijn.
Declares that, in having inadequately defined the waters which are vulnerable to pollution by nitrates from agricultural sources, in having inadequately classified vulnerable zones and in having adopted action programmes, as provided for under Article 5 of Council Directive 91/676/EEC of 12 December 1991 concerning the protection of waters against pollution caused by nitrates from agricultural sources, which include measures which are incompatible with the directive, the Republic of Poland has failed to fulfil its obligations under Article 3 of Directive 91/676, read in conjunction with Annex I thereto, and under Article 5 of that directive, read in conjunction with Annexes II A(2) and III(1)(1) thereto.

On 22 October 2007, the Commission adopted Decision 2007/697/EC granting a derogation requested by Ireland pursuant to Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources (2), allowing Ireland the application of 250 kg nitrogen per hectare per year from livestock manure on farms with at least 80 % grassland.
