Ten slotte stelt het Gerecht vast dat hoewel verzoekster geen argument of middel aanvoert ter onderbouwing van de verzoeken in het eerste onderdeel van de nota van 28 juli 2009, dit niet wegneemt dat uit de bewoordingen van die nota kan worden afgeleid dat zij erover klaagt dat zij stukken waar zij herhaaldelijk om heeft gevraagd, met name in haar e-mail van 14 mei 2009 betreffende schriftelijk examen b) alsmede in haar e-mail van 4 juli 2009 en in haar verzoek om heronderzoek van 10 juli 2009 betreffende schriftelijk examen c), niet heeft ontvangen. The Tribunal finds, lastly, that, even though the applicant does not put forward any argument or plea in support of the requests forming the subject-matter of the first part of the note of 28 July 2009, the fact remains that it may be inferred from the actual wording of the note of 28 July 2009 that the applicant was complaining that she had not received the documents she had asked for several times, inter alia in her e-mail of 14 May 2009, concerning written test (b), and in her e-mail of 4 July 2009 and her request for review of 10 July 2009, concerning written test (c). It follows that, in view of the circumstances of this case, the first part of the note of 28 July 2009 should have been regarded by EPSO as being a complaint within the meaning of Article 90(2) of the Staff Regulations.

1. Member States shall conduct inspections on the compliance of undertakings with this Regulation, following a documented, risk-based approach, including inspections on imports and exports of controlled substances as well as of products and equipment containing or relying on those substances.

Member States shall ensure that the tests are carried out in accordance with the provisions relating to good laboratory practice laid down by Council Directive 87/18/EEC of 18 December 1986 on the harmonization of laws, regulations and administrative provisions relating to the application of the principles of good laboratory practice and the verification of their applications for tests on chemical substances(4) and Council Directive 88/320/EEC of 9 June 1988 on the inspection and verification of good laboratory practice (GLP)(5).
