Onverminderd de toepassing van Verordening (EG) nr. 1829/2003 van het Europees Parlement en de Raad van 22 september 2003 inzake genetisch gemodificeerde levensmiddelen en diervoeders 10 op genetisch gemodificeerd stuifmeel in honing, moet derhalve worden verduidelijkt dat stuifmeel een bestanddeel is van honing, dat een natuurlijk product is zonder ingrediënten, en niet een ingrediënt in de zin van Richtlijn 2000/13/EG.
It is necessary therefore to clarify, without prejudice to the application of Regulation (EC) No 1829/2003 of the European Parliament and of the Council of 22 September 2003 on genetically modified food and feed 10 to genetically modified pollen in honey, that pollen is a constituent of honey, which is a natural substance that has no ingredients, and not an ingredient within the meaning of Directive 2000/13/EC.

Taking into account the natural character of honey, and in particular the natural origin of the presence of constituents particular to honey, including pollen, it is necessary to clarify that pollen and any other constituents particular to honey should not be considered as 'ingredients' of honey within the meaning of Regulation (EU) No 1169/2011.

Onverminderd de toepassing van Verordening (EG) nr. 1829/2003 van het Europees Parlement en de Raad van 22 september 2003 inzake genetisch gemodificeerde levensmiddelen en diervoeders op genetisch gemodificeerd stuifmeel in honing, moet derhalve worden verduidelijkt dat stuifmeel een bestanddeel is van honing, dat een natuurlijk product is zonder ingrediënten, en niet een ingrediënt in de zin van Richtlijn 2000/13/EG.

Op 6 september 2011 deed het Europese Hof van Justitie uitspraak in deze zaak en kwam tot de conclusie dat: a) de eerdere interpretatie van het toepassingsgebied van de GGO-wetgeving onjuist was (deze wetgeving was volledig van toepassing op genetisch gemodificeerd stuifmeel in honing) en b) stuifmeel in honing als ingrediënt moest worden beschouwd.
On 6 September 2011, the European Court of Justice issued its judgement where it indicated that: a) the previous understanding of the scope of GMO legislation was wrong (this legislation was fully applicable to GM pollen in honey) and b) that pollen in honey was to be considered as an ingredient.

On the other hand, Mr Bot takes the view that both honey in which pollen from MON 810 maize is detected and pollen-based food supplements containing pollen from that same variety of maize are produced from GMOs.

In dat verband zijn het feit dat het betrokken stuifmeel afkomstig is van een GGO waarvoor toestemming tot doelbewuste introductie in het milieu is verleend, en de omstandigheid dat bepaalde andere van dat GGO afgeleide producten rechtmatig als levensmiddelen in de handel mogen worden gebracht, niet doorslaggevend, aangezien honing waarin dit stuifmeel aanwezig is, niet valt onder een overeenkomstig verordening nr. 1829/2003 afgegeven vergunning.
In that regard, the fact that the pollen in question comes from a GMO authorised for deliberate release into the environment and the fact that certain other products from that GMO may lawfully be marketed as food are not decisive because the honey containing that pollen is not covered by an authorisation issued under Regulation 1829/2003.
