Artikel 5 zegt niets over verzoeken om toegang tot bewijsmateriaal van buiten de EU. Bewijzen van een mededingingsbeperkende overeenkomst of regeling binnen de EU mogen evenwel niet als surrogaat worden gebruikt in het kader van (collectieve) schadevorderingen buiten het rechtsgebied van de EU.
