By its appeal, the French Republic seeks to have set aside the judgment of the Court of First Instance of the European Communities of 4 December 2008 in Case T‑284/08 People’s Mojahedin Organisation of Iran v Council [2008] ECR I‑3487 (‘the judgment under appeal’), by which that court upheld the action brought by the People’s Mojahedin Organization of Iran (‘the PMOI’) for annulment of Council Decision 2008/583/EC of 15 July 2008 implementing Article 2(3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism and repealing Decision 2007/868/EC (OJ 2008 L 188, p. 21, ‘the contested decision’), insofar as it concerned the PMOI.

The Framework Decision therefore seeks to prevent an infringement of the principle of ‘ne bis in idem’, as set out in Article 54 of the Convention implementing the Schengen Agreement of 14 June 1985 between the Governments of the States of the Benelux Economic Union, the Federal Republic of Germany and the French Republic on the gradual abolition of checks at their common borders as interpreted by the Court of Justice of the European Communities.
